1. Rajnesh Vs. Neha & Anr (Crl) Appeal no.730 of 2020

In this case, the Supreme Court of India issued guidelines to be implemented in cases related to maintenance throughout India. The court held that the husband is not required to pay maintenance in each of the proceedings/case filed by the wife under different maintenance laws.

2. Mamta Jaiswal Vs. Rajesh Jaiswal, Madhya Pradesh High Court Civil Revision No.1290 of 1999

Decided on 24.03.2000, the High Court of Madhya Pradesh held that well-qualified spouses desirous of remaining idle, not making efforts for finding out a source of livelihood, have to be discouraged. The court further held that a lady, who is fighting matrimonial litigation filed for Divorce, cannot be permitted to sit idle and to put her burden on the Husband for demanding pendente lite alimony from him during the pendency of such matrimonial petition.

3. Damanreet Kaur Vs. Indermet Juneja & Anr. 2012 4 JCC 2375

In this case, it was held that if the wife was working in the past and resigned from the employment, she is not entitled to maintenance under the Domestic Violence Act1. The court also imposed a cost of Rs. one lakh for filing a false Domestic Violence case against the husband and in-laws.

4. Harish Upreti vs Geeta on 4 March, 2021

In this case, the Delhi District Court directed the husband, Harish Upreti, to pay interim maintenance of Rs.10,000 per month to the respondent/complainant and Rs.5000 each towards two minor children, from the date of filing of the case and till its disposal.

In this case, the Punjab-Haryana High Court ruled in favour of the husband, Naveen1. The court found that Veena, the wife, had a quarrelsome nature and her family members interfered in their matrimonial life. Veena’s brothers even subjected Naveen and his father to merciless beatings.
