One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.

Mr.X applied for a fresh passport from the Regional Passport Office in City A. After completing all formalities and paying the required fees, he received a confirmation with file number XYZ123. On DD/MM/YYYY, a package was delivered to his address containing an envelope with his name, address, and file number. However, upon opening, Mr.X discovered that the passport inside belonged to Mr.Y, a completely different person from Area B. The delivery occurred while Mr.X was away, so his mother received the package from the postal worker. When she inquired about the error, the postal worker suggested visiting the Regional Passport Office directly to resolve the issue.

Applicable Sections of Law
Under the Bharatiya Nyaya Sanhita (BNS), Section 318 deals with cheating and wrongfully concealing facts. Section 61 addresses criminal breach of trust if any official negligence is involved. The Bharatiya Nagarik Suraksha Sanhita (BNSS) Section 173 covers investigation procedures for administrative errors. Additionally, the Passport Act 1967 and Passport Rules 1980 govern passport-related issues and penalties for mishandling official documents by authorities.

How the Police Behave in Such Cases
Police typically treat passport delivery errors as administrative issues rather than criminal matters initially. They may refer you back to the Regional Passport Office for resolution. However, if there’s evidence of intentional fraud or document tampering, they will register an FIR under relevant BNS sections. Police cooperation increases when you provide complete documentation and evidence of the error.
