Mr.X attempted to book a train ticket through XYZ Railway’s official mobile application on DD/MM/YYYY. After selecting his preferred train and entering passenger details, he proceeded to payment using UPI. He entered his UPI ID and completed the payment authorization through his banking app. However, the railway booking application continued displaying “Waiting for Payment” status. Despite the payment being debited from his bank account, the transaction timed out after several minutes, and no ticket was generated. Mr.X found himself in a situation where money was deducted but no service was provided, creating both a financial and travel planning crisis.

Applicable Sections of Law

This case involves multiple legal provisions under the Bharatiya Nyaya Sanhita (BNS) and Bharatiya Nagarik Suraksha Sanhita (BNSS). Section 318 of BNS deals with cheating and dishonestly inducing delivery of property. Section 319 of BNS covers punishment for cheating. Additionally, provisions under the Consumer Protection Act 2019, Information Technology Act 2000, and specific railway regulations apply. The BNSS provides procedural guidelines for filing complaints in such digital fraud cases.
