One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.

Mr.X approached me after purchasing an expensive action camera worth Rs. 55,000 from X.brand Electronics. Upon unboxing and checking the device settings, he discovered that the camera had been activated a month prior to his purchase date. This indicated that the product was either used, returned, or had been in circulation before being sold to him as a “new” device. Mr.X was concerned about warranty implications, potential fraud, and his rights as a consumer. The retailer initially dismissed his concerns, claiming it was normal for devices to have pre-loaded software dates. However, activation dates clearly showed user interaction, making this a case of misrepresentation and potential consumer fraud.
Advice in Such Cases
Consult with Lawyer: The very basic and important step to start is talk to Lawyer / advocate. You should not hesitate in paying his consultation fee i.e. might be in range of Rs. 10,000 to 50,000 depends case to case. He is helping you in this situation to come out. He is expert in the domain and can help you explain the procedure which you might have never explored. A good lawyer can get the issues resolved much faster than you think.
Document everything immediately including purchase receipt, device serial numbers, and activation timestamps. Take screenshots of the device settings showing the pre-activation date. Contact the retailer in writing demanding explanation and remedy. If refused, escalate to consumer forum or file complaint under Consumer Protection Act for unfair trade practices and deficiency in service.
Applicable Sections of Law
Under Bharatiya Nyaya Sanhita (BNS), Section 318 deals with cheating and dishonestly inducing delivery of property. Section 319 covers cheating by personation. Consumer Protection Act 2019 applies for unfair trade practices. Under BNSS, Section 173 allows filing of complaint for cognizable offenses. Sale of Goods Act 1930 governs implied conditions about quality and fitness. These provisions protect consumers from fraud and misrepresentation in commercial transactions, ensuring right to genuine products as advertised.
If You Are the Complainant
- Gather all purchase documents, warranty cards, and payment receipts immediately
- Document the pre-activation evidence with photographs and screenshots of device settings
- Send written notice to retailer demanding replacement or full refund within reasonable timeframe
- File complaint with District Consumer Disputes Redressal Commission if retailer refuses
- Consider police complaint under BNS for cheating if fraud is evident and retailer shows bad faith
If You Are the Victim
- Immediately stop using the device to preserve evidence of its pre-activated state
- Contact manufacturer directly to verify activation date and warranty status independently
- Demand immediate replacement or full refund from retailer with written notice
- File consumer complaint if retailer denies responsibility or offers inadequate remedy
- Consider claiming compensation for mental harassment and time loss in addition to refund
How the Police Behave in Such Cases
Police typically treat such matters as civil consumer disputes initially. However, if clear fraud evidence exists showing deliberate misrepresentation of used goods as new, they may register FIR under cheating provisions of BNS. Investigation involves examining sales records, device activation logs, and retailer’s explanation. Police may recommend consumer forum route for quicker resolution unless criminal intent is clearly established through evidence of systematic fraud.
