The wallet contained his debit card from XYZ Bank, approximately Rs. 15,000 in cash, driving license, and important identification documents. He was unsure whether this constituted theft or simple loss, and whether filing an FIR was necessary. Mr.X was particularly concerned about potential misuse of his debit card and wanted to understand the legal implications. After reviewing his situation, I advised him on the immediate steps to take and the legal procedures involved. Under the Bharatiya Nyaya Sanhita (BNS), several sections may apply depending on circumstances. Section 303 BNS deals with theft if someone intentionally takes your wallet. Section 316 BNS covers criminal breach of trust if found property is not returned. Section 318 BNS addresses cheating if your cards are misused fraudulently. Under Bharatiya Nagarik Suraksha Sanhita (BNSS), Section 173 allows you to file a complaint for cognizable offenses, while Section 205 covers the investigation process for such matters.
