Mr.X approached me after losing his X.brand smartphone in City A between Area X and Area Y. He was carrying both his primary phone and a spare X.brand device when the incident occurred. The spare phone, which was fully charged but had no active SIM card, apparently slipped from his pocket. Mr.X was unsure of the exact location where he lost it but suspected it happened while traveling between these busy areas. The phone contained personal data and photos, making its recovery important. Initially uncertain whether to file a police complaint for a lost phone, Mr.X needed guidance on the legal procedures and his rights in such situations.

Applicable Sections of Law

Under the Bharatiya Nyaya Sanhita (BNS), Section 303 deals with theft of movable property. Section 317 covers criminal misappropriation of property. The Bharatiya Nagarik Suraksha Sanhita (BNSS) Section 173 allows police to register FIR for theft cases. Section 35 of BNSS empowers police to investigate lost property cases and recover stolen goods.

  • Immediately try calling your lost phone from another number
  • Use Google Find My Device or Apple Find My iPhone services if activated
  • Contact your mobile network provider to suspend services on lost SIM
  • Change passwords for all apps and accounts accessible through the phone
  • Check nearby areas thoroughly before concluding it’s stolen or lost permanently

Police typically register lost phone cases under theft sections initially. They may ask for phone purchase bills, IMEI numbers, and detailed circumstances. Investigation involves checking with local mobile repair shops and second-hand dealers. Police often coordinate with cyber cells to track phone location if it gets activated. However, priority for investigation may be lower compared to other serious crimes.
