One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.
Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.
Mr.X approached me with a complex documentation issue that had been causing him significant problems for years. His actual date of birth was DD/MM/2009, but due to a clerical error during registration, his birth certificate showed DD/MM/2007 – making him appear two years older than he actually was. This discrepancy had cascaded through all his official documents including school admission records, board examination certificates, and other identity proofs. The error was preventing him from applying for age-appropriate educational opportunities and government schemes. His parents had initially provided incorrect information to avoid school admission age restrictions, but now the family realized the long-term consequences. Mr.X needed to correct this fundamental error across multiple government departments and educational boards. The case required navigating through civil registration procedures, court applications, and coordination with various authorities including the Registrar of Births and Deaths, Education Board, and other relevant departments.

Applicable Sections of Law
The Registration of Births and Deaths Act, 1969, governs birth certificate corrections. Under BNS Section 177, providing false information in official documents is an offense. BNSS Section 195 deals with procedure for correction of public records. The Right to Information Act, 2005, can be used to obtain information about the correction process. Section 15 of Registration of Births and Deaths Act allows correction of errors in registered documents within one year, while Section 17 provides for corrections after one year with proper evidence. These provisions ensure that genuine errors can be rectified through appropriate legal channels while preventing misuse of the correction process.
If You Are the Complainant
- File a formal application with the Registrar of Births and Deaths along with supporting documentary evidence proving the correct date of birth
- Submit hospital delivery records, vaccination certificates, and early school admission documents as primary evidence

- If correction is denied, file a petition in the District Court under appropriate civil procedure for mandamus
- Simultaneously approach education boards and other relevant authorities for consequential corrections once birth certificate is amended
If You Are the Victim

- Collect medical records from birth, early childhood vaccination records, and any contemporary documents showing correct age
- Obtain certified copies of all current documents showing the incorrect date for systematic correction
- File correction applications in chronological order starting with birth certificate, then academic records, then other documents
- Maintain detailed records of all applications, correspondence, and official responses for future reference and legal proceedings if necessary
How the Police Behave in Such Cases
Police involvement typically occurs only if fraud is suspected or if someone files a criminal complaint alleging intentional falsification. They generally refer civil documentation matters to appropriate civil authorities. Police may investigate if there are allegations of document forgery or if multiple people are found with similar discrepancies suggesting systematic fraud. In genuine correction cases, they usually provide guidance to approach civil registration authorities rather than treating it as a criminal matter.
