Ms. X was traveling from City A to City B for business purposes. During security screening at the airport, authorities discovered personal wellness items in her carry-on baggage. Despite these being legal personal items, the security personnel and later airport police created unnecessary harassment and detained her for several hours. They questioned her inappropriately about the items and threatened to file charges for carrying “obscene materials.” Ms. X faced humiliation, missed her flight, and suffered mental trauma due to the unprofessional conduct of the authorities. The incident violated her fundamental rights to privacy and dignity, as these items were for personal use and completely legal to possess and carry during travel.

Applicable Sections of Law

Section 74 BNS addresses wrongful confinement when authorities detain someone without proper legal justification. Under Bharatiya Nagarik Suraksha Sanhita (BNSS), Section 35 provides procedures for arrest that must be followed by authorities. Constitutional Articles 14, 19, and 21 guarantee equality, freedom of movement, and right to life with dignity respectively.
If You Are the Complainant
- File FIR immediately against the harassing officials for misconduct and illegal detention
- Submit complaint to airport authority and CISF about unprofessional conduct of security personnel
- Document all financial losses including missed flights, hotel bookings, and business meetings
- File complaint with National Human Rights Commission for violation of fundamental rights
- Approach consumer court for compensation due to deficiency in airport services

- Remain calm and assert your rights politely but firmly during questioning
- Request presence of female officer if you are a woman and insist on privacy
