SC certificate validity for a government job depends on State notification, not residence or marriage. What scrutiny means for your service, and your options.

The call usually comes after office hours. Someone has an envelope, or a photograph of an envelope forwarded on WhatsApp, and the first sentence is almost always the same. Sir, is this serious?

I ask for three things before anything else gets discussed — the whole document, not one page of it, the date printed on it, and how it was delivered. Those three answer most of the question on their own. What people describe to me first is the argument, the history, the money, the family fight. That part matters, but it is not what decides the next two weeks.

What most people do with a notice is wait. Not because they have a plan, but because they are not sure whether it is a court summons and they don't want to touch it. By the time they call, the reply deadline printed on the document has usually passed, or the sender has already filed. In the case I am describing, that gap was the entire problem. We only had one side of the story at that point, and that is normal — a notice is written to make you look bad, and it usually succeeds.

  • A legal notice is a formal demand or intimation. It is not a summons from a court and it does not, by itself, create a case against you.
  • The time to reply is usually stated in the notice itself. Fifteen days and thirty days are the common windows.
  • Ignoring a notice rarely makes it disappear. It usually speeds up whatever the sender does next.
  • Some notices are statutory — the law requires them before a case can be filed, and the timeline is fixed. A dishonoured cheque notice is the clearest example.
  • For a dishonoured cheque, the notice must be sent within thirty days of the dishonour, and the drawer then gets fifteen days to pay. If those windows are missed, the criminal complaint route under the Negotiable Instruments Act generally closes.
  • Screenshots, emails and chat messages are evidence only if they are preserved properly and usually need a certificate under Section 63 of the Bharatiya Sakshya Adhiniyam, 2023 before a court will rely on them.
  • If the notice has come from the police, you have a right to consult a lawyer, and a constitutional right against being compelled to be a witness against yourself.

First, work out which of the three kinds you have received

The reply to a company lawyer, a tax officer and a police station are not the same document, and writing one as though it were the other causes new problems. Sort it before you write anything.

A notice from a person or a company

This covers cheque dishonour, unpaid invoices, loan and credit card recovery, tenancy disputes, defamation, breach of contract and matrimonial demands. These are the ones where the deadline in the notice matters most, because the sender is building the record that a court will later read.

A notice from a department

Income tax, GST, municipal, labour or regulatory. These are governed by their own statutes, each with its own limitation and its own appeal route. Some are purely informational and need only an acknowledgement. Others require a reply within a fixed period, and a missed period can mean the demand becomes final.

A notice from the police or an investigating agency

This is a different animal. It may require your presence on a date. Do not treat it as correspondence to be ignored or as a negotiation. Read the date, read the capacity in which you are being called — witness or accused — and take advice before you attend.

What happens if you do not reply

In a cheque matter, silence generally leads to a criminal complaint. In a civil dispute, it usually leads to a suit, and your silence gets described in the plaint as an admission. In a departmental matter, silence can mean the assessment or demand is confirmed and your appeal window shrinks. None of these outcomes is automatic, and none is certain, but they are all more likely than the notice simply being forgotten.

Briefly, in writing, through a lawyer if the stakes justify it, and on time.

  • Answer each allegation by number. A reply that ignores half the paragraphs is read as an admission of those paragraphs.
  • Deny specifically. "The allegations are denied" is worth very little. "I paid ₹X on this date by this mode" is worth a lot, if it is true.
  • Do not volunteer explanations. Every extra sentence you write becomes a document the other side will produce later.
  • Do not send the angry version. I have seen replies, drafted by the client and sent at midnight, that did more damage than the original notice.
  • Keep proof of sending. Registered post, speed post, courier, email — whatever mode, keep the receipt and the tracking record.

A reply is not filed in any court. It is correspondence. But it becomes evidence the moment a case starts, and it is often the first document a judge reads about you.

Preserve the record before you do anything else

People delete chats when they are frightened. Do not. Do not factory-reset the phone, do not clear a mailbox, do not remove a WhatsApp group. Take complete backups, keep the device that holds the original, and keep the extracted copy separate. Courts now deal with electronic evidence routinely, but the certificate requirement under the Bharatiya Sakshya Adhiniyam, 2023 means sloppy preservation can sink an otherwise strong case.

If the notice has come from the police

Ask for a copy and keep it. Note the date, the time and the name and designation of the officer. You are entitled to know the grounds on which you are being called and to consult a lawyer of your choice. You are not obliged to sign a statement you have not read, and anything you say can be used. Attend on time — non-appearance creates its own problems — and attend with advice taken beforehand, not after.

What it realistically costs in time

A reply to a notice takes a few days to draft once the papers are in hand. If it moves to litigation, you should think in months for interim orders and years for a final decision. Anyone who tells you a notice will be resolved in a fortnight is guessing. On some facts there is genuinely nothing to argue — where the transaction is documented, admitted and unpaid, the honest advice is to negotiate rather than fight, and a reply then becomes a settlement letter rather than a defence.

What to send, and where

Send the entire notice as a scan or a clear photograph of every page, the date on it, and how it reached you — post, courier, email, or hand. Add any earlier correspondence between you and the sender. Then a two-line note in your own words about what you think the dispute is actually about. That last part matters more than people expect, because the notice rarely describes the real fight.

You can reach the chamber through /contact-us or fix a time at /book.

Frequently Asked Questions

Do I have to reply to a legal notice?

There is no general legal duty to reply to a private notice. But not replying is a choice with consequences, and in cheque matters and departmental matters the consequences are usually worse than a carefully drafted reply.

What if I genuinely owe nothing?

Then say so in writing, with dates and documents, and keep proof that you sent it. A clean denial on record is what you will want to point to when the case starts.

Can a legal notice be sent by WhatsApp or email?

Often yes. Whether that mode was valid depends on the statute involved, any contract between the parties, and how the notice was actually received. This is one of those questions that turns entirely on the facts.

Will replying make things worse?

A careless reply can. A reply that admits facts you did not need to admit can be produced against you later. That is the reason to have it drafted rather than written in one sitting.

Can I settle directly without going to court?

Frequently. In cheque and recovery matters, settlement before a complaint is filed is common and usually cheaper for both sides. What you should not do is negotiate without the reply deadline being protected in parallel.
