One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.
Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.
TL;DR: Two employers can show up under the same UAN at the same time, and PF overlap by itself is not unlawful, it is only visible. The real danger is the false declaration your new employer's HR is asking you to make during background verification, plus the relieving letter your current employer can sit on. Fix the exit in writing before you resign, and never suppress an employer in onboarding.
Key Facts of the Case
- Joined a service-based IT employer in Pune in mid-February 2025, with a ninety-day notice period written into the appointment letter.
- Received an offer from a product company in Bengaluru in early March 2025 at roughly double the pay, with a joining date of 1 April.
- The new employer's HR advised him not to disclose the current employer during onboarding and to submit the previous employer's documents instead.
- His UAN already existed from an earlier job. The current employer had opened a separate member ID under it and credited one month's contribution.
- The manager confirmed that exits at the current employer are not closed promptly, so overlapping employment and PF dates were inevitable.
- No resigning employee has a statutory right to a relieving letter, though the employer cannot arbitrarily withhold earned dues.
- The exposure was a false BGV declaration and a missing relieving letter, not the PF overlap itself.
Rohan Deshpande signed the appointment letter without reading clause 12 properly. Mid-February 2025. A service-based IT employer in Pune, a senior engineer role, ninety days' notice. He saw the clause. He just didn't think about it.
In early March, a product company in Bengaluru offered him the same work at nearly double the pay. One condition, join by 1 April. When he said that was impossible, the new employer's HR suggested something else. Leave the current employer out of onboarding. Submit the older documents instead.
Then the details piled up. His UAN predated the current job. The Pune employer had already opened a fresh member ID under it and credited a month's contribution. A manager mentioned, in passing, that exits at that company are never closed on time. The overlap was going to happen whether he resigned or simply stopped going.
He first took a general practitioner's view. The answer, that PF overlap is harmless, missed the two things that could actually hurt him: a withheld relieving letter and a false declaration in verification. He then approached the Chamber of Advocate Sudhir Rao. The exit was negotiated in writing, notice recovery was adjusted against the final settlement, the relieving letter was issued, and the PF records were reconciled before onboarding began. Advocate Sudhir Rao's experience with employment records and PF compliance is what moved a silent employer to a written closure and kept the new offer intact.
The Direct Legal Answer
Can two employers show as active under the same UAN?
Yes. A UAN is permanent and unique to you, but each establishment you join creates its own member ID under it. Two member IDs with overlapping contribution periods are technically possible and EPFO does not treat that as an offence. You will simply see both entries in your passbook.
Does PF overlap automatically become a moonlighting issue?
No. Moonlighting is a contractual question, decided by the exclusivity and full-time-employment clauses in your appointment letter, not by PF records. Overlap is is a record. It becomes a problem only when it contradicts something you signed, or when someone decides to use it as proof that you were employed elsewhere while telling a different story.
What does PF overlap under two employers on one UAN look like?
Your UAN is permanent. It is tied to you, not to a company. Every establishment you join opens its own member ID under that UAN, which is why a single passbook can show two live member IDs with contributions for the same month.
EPFO's job is to credit money and keep records. It is not a policing agency for employment contracts. Nothing in the EPF and Miscellaneous Provisions Act, 1952 or the EPF Scheme, 1952 makes it an offence for two establishments to remit contributions for you in the same wage month.
What you will actually see:
- Two member IDs under one UAN, each with its own establishment code.
- Two contribution lines for an overlapping month, with the employer name printed against each.
- A transfer claim (Form 13) or a member ID merge later, at which point the overlapping months sit next to each other in one passbook.
That is the whole of the PF problem. It is a clerical merge, not a charge. The reason it feels dangerous is that it is the only permanent, third-party record anyone can pull to prove where you were and when.
Where the real exposure actually sits
1. The declaration you sign while joining
Rohan's new employer did not ask him to hide the Pune job by accident. Suppressing a current employer is a standard shortcut in a hiring market where notice periods run ninety days and joining dates do not wait. It works until it does not.
Almost every offer letter carries a clause that the information you furnish is true and complete, and that a false statement is grounds for withdrawal of the offer or termination without further notice. A background verification vendor checks employment history against EPFO records or against the previous employer's HR. When the passbook and the declaration disagree, the declaration is what gets you, not the contribution.
On the criminal side, an employer that feels it was induced to hire on the strength of a false statement can frame a complaint of cheating under the Bharatiya Nyaya Sanhita, 2023. Submitting another person's documents, or a fabricated relieving letter, moves the matter into the personation and forgery provisions. Whether a police complaint survives is a separate question, and on plain facts of a suppressed employer it often should not. But that argument is made later, by a lawyer, in a worse position than you needed to be in.
The correct move is boring. Disclose the current employer. Ask the new company to document the notice buyout or an early release in the offer itself, so its own HR is protected and stops asking you to lie.
2. The relieving letter and the full and final settlement
There is no statutory right to a relieving letter in India. It is a contractual and policy document, and no section of any Act compels an employer to issue one. What the employer cannot do is sit on money you have already earned for work already done, indefinitely, without a lawful reason.
Deductions from wages are permitted only where the law allows them — the Payment of Wages Act, 1936 lists the categories and requires the employee to fall within its wage ceiling. Rohan's salary, at roughly double his earlier pay, would likely sit outside that ceiling, which means the contract and general contract law govern, not the Act. Notice pay recovery is usually the employer's strongest card if clause 12 says ninety days and the employee walked in thirty.
What the employer cannot generally get is an order forcing you to serve out your notice. A contract of personal service is not specifically enforceable, so the usual outcome is a money adjustment, not a court order telling you to keep working. That is a reason for the employer to negotiate the notice period into a payout, and a reason for you not to leave it undefined.
What happens first if this surfaces
The sequence is predictable. The verification vendor flags the discrepancy. The new employer's HR asks for an explanation in writing with a deadline, often two or three working days. The offer is put on hold. The old employer, having heard from a verification call, stops the settlement.
From there it depends entirely on what you signed. If you disclosed and the old employer is simply stalling on the relieving letter, this is an employment dispute with a paper trail. If you signed a false declaration, or submitted a document that was not yours, the same file can carry an FIR, and the remedy becomes an application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, followed by a petition to quash the proceedings in the High Court. Both are possible. Both are avoidable.
Electronic evidence matters here. Emails from HR suggesting you leave the employer out of onboarding, and your replies, will be proved through a certificate under Section 63 of the Bharatiya Sakshya Adhiniyam, 2023. Keep them. Do not delete the thread because it embarrasses someone.
How the exit should be papered
- Resign in writing, never verbally. Email plus HR portal, with the resignation date and the last working day stated as you intend it.
- Ask for a written waiver or buyout of the unserved notice. Get the amount and the set-off confirmed by email before the last working day.
- Get the acceptance on record. A resignation that is not accepted in writing becomes the dispute six weeks later.
- Get the final settlement statement. Salary to the last day, leave encashment, notice recovery if any, and the net payable, in a single sheet.
- Get the relieving letter and the experience letter as separate documents. Ask for them before the settlement, not after.
- Reconcile PF. Check the passbook for the overlapping entries, then file the transfer or merge so the record is clean before the new employer's verification team looks at it.
- Keep the entire chain in one folder. Offer, appointment letter, resignation, acceptance, settlement statement, relieving letter, passbook extract.
What to gather before you resign
- The appointment letter, opened at the notice period clause.
- The new offer letter, read for joining date and notice-buyout terms.
- The PF passbook, downloaded, showing both member IDs.
- Every email or message from the new employer's HR about what to disclose.
- The employee handbook or HR policy on notice, buyout and relieving letters, if you have it.
How long this takes
Resignation to last working day is whatever the notice period says, or whatever the waiver says. Full and final settlement at large service companies usually lands thirty to sixty days after the last working day, sometimes longer where an overlap has to be investigated. A PF transfer or member ID merge runs a few weeks more, largely dependent on how quickly the previous employer approves the claim. If a dispute starts, a labour authority response can take months and a civil recovery suit longer.
When there may be nothing to argue
If you signed a declaration that suppressed your current employer, submitted documents belonging to a different employment, or simply stopped attending without resigning, there is often little to contest on the merits. In that situation the work is damage control — correcting the record quickly, explaining before the employer reports you, and negotiating a settlement instead of litigating a losing point. Knowing when to fold early is worth more than a defence that arrives two months late.
Frequently Asked Questions
Is it illegal in India to hold two jobs at the same time?
There is no general law banning dual employment for private-sector employees. It is a contract question. If your appointment letter has an exclusivity or full-time-employment clause, breaching it is a contractual wrong, and it is a valid ground for termination. The PF record merely proves the facts.
Can my employer withhold my relieving letter because I did not serve the notice period?
An employer can decline to issue a relieving letter, because no statute compels it. It cannot hold back earned salary indefinitely for a reason the contract does not support, and the practical answer is a negotiated buyout recorded in writing, not a fight about the letter.
Will EPFO merge my two member IDs automatically?
Not reliably. You file the transfer claim, and the previous establishment has to approve it. Overlapping periods sometimes need an explanation from you. Do this before joining the new employer rather than during verification.
Can I be prosecuted for a false declaration in background verification?
Termination and offer withdrawal are the common consequences. A criminal complaint is possible where the employer alleges it was induced to hire on a false statement, or where documents were fabricated or belonged to someone else. How far such a complaint goes depends heavily on the documents and on what the employer can prove about its own reliance.
Do I have to show both salaries in my income tax return?
Yes. Each employer deducts tax and issues its own Form 16, and both must be declared in your return. A mismatch here is picked up by the income tax system independently of any verification check, which is another reason concealment does not hold for long.
What to send the Chamber
If you are sitting on a resignation you have not sent, or a verification email with a two-day deadline, send the appointment letter with the notice clause, the new offer letter, the PF passbook extract showing both member IDs, and the emails from HR. Two lines on the timeline is enough — what date you joined, what date you are being asked to join. Put it through /contact-us or /book and bring the documents, not a summary of them. The earliest point in this sequence is the cheapest one to fix.
This article is general information about Indian law and is not legal advice on your situation. Employment contracts, PF records and verification outcomes turn on the specific documents involved, and you should have your own papers read before acting.
