One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.
Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.
TL;DR: A payment processor freezing your account over a shared IP alone — without human review — can be challenged via multiple legal routes. You can file a complaint before the RBI Ombudsman, send a formal legal notice demanding manual KYC review, and approach the consumer court if your livelihood is impacted. The law protects you from arbitrary automated decisions that freeze legitimate funds.
Priya Verma ran a small handmade textile business from her home in Indore. She sold through Etsy, which forced Indian sellers to use Payoneer for payment processing. Her business was registered as an MSME with her own PAN, GST, and bank account. In early April 2025, her father — who ran a separate business — needed help opening his own Payoneer account. Priya let him use her laptop and home Wi-Fi. Within hours, Payoneer's automated system flagged the shared IP address and permanently blocked both accounts. No human reviewed anything. The support bots just sent automated rejections. Funds from shipped orders were frozen. Her Etsy shop was suspended automatically. Handwoven rugs worth lakhs sat ready to ship, unprocessable. She approached her local lawyer first. That didn't work. Then she reached the Chamber of Advocate Sudhir Rao. The office sent a formal legal notice to Payoneer's India Nodal Officer, demanding a manual KYC review and release of frozen funds within seven days. Simultaneously, a complaint was drafted for the RBI Ombudsman. Advocate Sudhir Rao's domain expertise in payment regulatory litigation helped secure the order in favour of the client, forcing Payoneer to conduct a human review and unfreeze the accounts within three weeks.Key Facts of the Case
- Two separate legal entities — independent PAN cards, GST registrations, and bank accounts — were flagged due to a shared home Wi-Fi IP address.
- Payoneer's automated system permanently blocked both accounts without any human review of submitted documents.
- Funds from already-shipped orders were entirely frozen, stopping the client's only source of income.
- The Etsy shop was automatically suspended as a downstream consequence of the Payoneer block.
- Payoneer refused manual KYC review despite repeated requests, relying entirely on bot responses.
- The client approached the Chamber of Advocate Sudhir Rao after initial efforts with a general practitioner did not yield results.
- A formal legal notice demanding manual review under the RBI's Master Direction on PPIs was issued, followed by a draft RBI Ombudsman complaint.
- The payment processor finally conducted manual KYC review and unfroze the accounts within three weeks of the legal notice.
The Direct Legal Answer
Can I complain to the RBI Ombudsman?
Yes. Payoneer is regulated by the RBI as a payment system operator. If their India Nodal Officer does not resolve your grievance within 30 days of your email, you can file a formal complaint before the RBI Ombudsman under the Reserve Bank of India — Ombudsman Scheme for Digital Transactions, 2019. This is a free, fast-track process that can direct the payment provider to release your funds and conduct a proper manual review.
Should I hire a lawyer to send a formal legal notice?
Absolutely. You don't need to wait 30 days. A legal notice from a lawyer experienced in fintech regulation forces the company to take you seriously. It puts them on notice that you intend to escalate — and often triggers a human response within days. In Priya's case, the legal notice led to resolution within three weeks.
Does this fall under Consumer Court?
Yes, it can. Even though this is a business account, the Consumer Protection Act, 2019 allows jurisdiction where the use of goods or services is for livelihood. Since your Etsy shop is your sole source of income, you fit the exception under Section 2(7) of the Act. But this route takes time — use it as the last option after the Ombudsman route.
Advice in Such Cases
Consult with Lawyer: The very basic and important step to start is talk to Lawyer / advocate. You should not hesitate in paying his consultation fee i.e. might be in range of Rs. 10,000 to 50,000 depends case to case. He is helping you in this situation to come out. He is expert in the domain and can help you explain the procedure which you might have never explored. A good lawyer can get the issues resolved much faster than you think.
Don't waste time with customer support bots. Escalate immediately to the Nodal Officer by email — keep a copy. Then have your lawyer draft a formal legal notice. This type of payment regulatory matter involves nuanced procedural strategies that a general practitioner may not be fully familiar with. Engaging an advocate who regularly handles fintech disputes and RBI compliance cases typically leads to faster outcomes.
Applicable Sections of Law
- RBI Master Direction on Issuance of Prepaid Payment Instruments (PPIs), 2021 — governs KYC norms and account freezing procedures by payment providers
- RBI — Ombudsman Scheme for Digital Transactions, 2019 — provides grievance redressal against payment system operators
- Consumer Protection Act, 2019, Section 2(7) — defines "consumer" to include persons using goods/services for livelihood, allowing business accounts to approach consumer forums
- Indian Contract Act, 1872, Section 73 — compensation for loss or damage caused by breach of contract (frozen funds without justification)
Jurisdiction — Where to File the Case
For the RBI Ombudsman, file the complaint online through the RBI's CMS portal — no territorial limitation applies. For a consumer complaint, file at the District Consumer Disputes Redressal Forum where your business is located, if the claim value is under Rs. 1 crore. For a civil suit, the competent court is where the cause of action arose (your place of business) or where Payoneer's registered office in India is situated. Jurisdiction matters because filing in the wrong forum wastes months of time.
Limitation Period
For approaching the RBI Ombudsman, complaint must be filed within one year from the date of the grievance. For consumer complaints, limitation is two years from the date of the cause of action under Section 69 of the Consumer Protection Act, 2019. For a civil suit for breach of contract, limitation is three years under the Limitation Act, 1963. Don't delay — the clock starts running the day your funds are frozen.
Interim Reliefs Available
You can seek the unfreezing of your funds as an interim measure. In a consumer forum, you can file an application under Section 38 of the Consumer Protection Act for interim orders. In a civil suit, Order 39 Rule 1 CPC allows temporary injunctions to prevent the payment provider from holding your funds without reason. The court can also direct release of a portion of frozen funds pending final hearing if you show irreparable loss to your livelihood.
If You Are the Victim
- Document everything — save all emails, chatbot conversations, and automated rejection messages as screenshots
- Email the Nodal Officer immediately with a formal grievance letter (keep a read receipt)
- Do not create another account or use a VPN — this can worsen the situation legally
- Engage a lawyer experienced in payment regulatory disputes to send a legal notice
- Consider switching to alternative payment processors like Razorpay or Cashfree after resolution
Documents You Must Keep Ready
- PAN card and GST registration certificate for your business
- Separate PAN card and GST certificate of the other party (your father / relative)
- Bank account statements showing deposits from Payoneer
- Copies of all communications with Payoneer support (emails, chatbot logs)
- Proof of shipped orders that are unpaid due to frozen funds
- Etsy account suspension notice or email
- Income tax returns showing this is your sole source of livelihood
What Evidence Is Required?
- Primary evidence: emails and communication logs from Payoneer showing automated block and refusal of manual review
- Documentary evidence: separate PAN, GST, and bank account records proving distinct legal entities
- Proof of loss: invoices for shipped but unpaid orders, bank statements showing frozen credits
- Screenshots of Etsy shop suspension notice
- Affidavit from the other party (your father/relative) confirming the accounts are separate
- Any correspondence with the Nodal Officer after your grievance email
- Video recording or screenshot of the shared IP being the only connection between the accounts
How Courts Typically Approach Such Cases
Courts take a dim view of automated decisions that freeze legitimate funds without human oversight. Consumer forums, in particular, recognise that payment providers operate under RBI's regulatory framework. The court will examine whether the provider followed its own KYC process fairly. If the provider cannot show a genuine fraud risk — and merely relied on IP sharing — the court will likely order immediate unfreezing and award compensation for lost business. The trend is pro-consumer where livelihood is affected.
Timeline of Legal Process
- Day 1: Email Nodal Officer — 30-day clock for Ombudsman eligibility starts
- Day 1: Send legal notice through advocate — expect response within 7-15 days
- Day 30: File RBI Ombudsman complaint if unresolved — resolution typically within 2-3 months
- Day 30: Simultaneously file consumer complaint — first hearing within 30 days of filing
- 3-6 months: Consumer forum final order in straightforward cases (expedited if livelihood is shown)
- 6-12 months: If matter goes to appeal before State Commission or National Commission
Understanding the Costs
The total cost of a matter like this varies significantly from one case to the next — it depends on the complexity of the dispute, the forum involved, the number of hearings, and the specific facts of your situation. There is no single fixed figure that applies to everyone.
A professional advocate can give you an accurate estimate only after reviewing all your facts and documents in a consultation.
Can the Matter Be Settled Out of Court?
Yes, and this is often the fastest route. Many payment providers — once served a legal notice — offer to settle by unfreezing funds and deactivating only the duplicate account. A settlement deed can be drawn up under Section 89 CPC, incorporating terms like fund release timeline, non-repetition of automated blocks, and confidentiality. Mediation before the RBI Ombudsman is also possible. Settlement is advisable if the amount frozen is modest and you want to resume business quickly.
Common Mistakes People Make
- Waiting too long — not sending a legal notice and relying on support bots for weeks (or months)
- Creating a new account with a different email or using a VPN — this can be treated as fraud under the provider's terms
- Deleting emails and communication records — preserve everything for evidence
- Posting about the issue on social media without a lawyer — this can prejudice your legal case and trigger defamation counter-claims
- Engaging a lawyer who does not regularly handle payment regulatory or consumer litigation — this type of matter requires familiarity with RBI circulars, Ombudsman procedure, and fintech terms of service that a general practitioner often misses
- Ignoring the Nodal Officer complaint route — the RBI Ombudsman is a free, effective remedy you should not skip
FAQs People Normally Have
How long does the RBI Ombudsman take to decide?
Typically 2-3 months from filing. The Ombudsman first attempts conciliation. If that fails, an award is passed. The process is free and does not require a lawyer, though having one improves outcomes.
Can I get compensation for lost income?
Yes. In consumer forum cases, courts regularly award compensation for loss of business and mental harassment if the provider's action was unjustified. The amount depends on the period of freeze and value of lost orders.
Is it legal for Payoneer to block both accounts just for sharing an IP?
Their terms of service allow automated blocks for suspected fraud. But the law requires a fair opportunity to prove separate identity. Arbitrary automated blocks without human review violate the RBI's PPI Master Direction on customer grievance redressal.
What if I haven't emailed the Nodal Officer yet?
Do it today. Keep a copy. The 30-day waiting period for the Ombudsman starts from your email. Also, your lawyer can send the legal notice simultaneously — you don't have to wait for the Nodal Officer to reply.
Do I need to approach Etsy separately?
Yes. Once your Payoneer account is resolved, contact Etsy's seller support with proof of resolution to reactivate your shop. Keep all correspondence. A lawyer can draft a letter to Etsy as well, but the primary fight is with Payoneer.
