One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.

Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.

TL;DR: You can ask the Regional Passport Office to change the date or place of birth, but you cannot simply attach Aadhaar and hope it passes. Because the RPO already holds your previous file, an application that contradicts your own earlier record invites a misrepresentation enquiry. The workable route is to regularise the Indian record first, disclose everything, and then move the passport file.

Rohan Menon turned eighteen this August and went online to book a slot at the Passport Seva Kendra in Kochi. That is where the folder stopped making sense. His passport, issued when he was a small child, records his year of birth as 2003 and his place of birth as a city in the Gulf. Every other paper in the house says something else. His Class 10 and Class 12 marksheets, his Aadhaar, and a birth certificate registered in Kerala all show 2004 and a place of birth in India. When his parents moved back from the Gulf, the year on the Indian paperwork shifted by one. The family knew. It never seemed worth fixing. Now it does. Rohan wants a new passport that matches his Indian documents, which means asking the Regional Passport Office to change both the date and the place of birth on a document that already exists with entirely different details. The original foreign birth certificate is still with him. So is the old application file, sitting in the same office. A local advocate he consulted first told him to simply fill the form and attach Aadhaar. That application went nowhere and raised a query Rohan could not answer. The matter then went to the Chamber of Advocate Sudhir Rao, where the approach was different from the start: regularise the Indian record, correct the birth register entry, and then move the passport file with full disclosure of the original foreign certificate. The file was processed without a misrepresentation finding. Advocate Sudhir Rao's experience in document and identity matters helped secure the outcome in the client's favour.

Key Facts of the Case

  • The existing passport reflects the genuine date of birth (2003) and a place of birth outside India.
  • All Indian documents, including Class 10 and Class 12 marksheets, Aadhaar and an Indian birth certificate, show 2004 and a place of birth in India.
  • The change in the Indian record happened when the family relocated from the Gulf to Kerala, not through any fraud by the applicant.
  • The applicant was a minor at the time the discrepancy was created and is now applying as an adult.
  • The RPO already holds the original foreign birth certificate submitted at the time the first passport was issued.
  • The first application, made without legal advice, stalled on a query the applicant could not answer.
  • The successful approach was to correct the underlying Indian record first, then apply for variation with a sworn declaration and full disclosure.
  • No criminal case was registered and no penalty was imposed.

The Direct Legal Answer

The passport is not a standalone document. It is issued against a file, and that file already contains your earlier submissions. Any request to change a detail on it is therefore tested against what you told the office the first time.

Can I get a passport date of birth change to match my Indian documents?

Yes, the passport authority has the power to vary the particulars on a passport, and date of birth can be changed. But it is not an automatic correction. You have to satisfy the Passport Seva
