OBC-NCL Certificate Error? PSU Job Cancelled, What Next

One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.

Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.

TL;DR: If a public sector employer cancelled your candidature only because your OBC-NCL certificate was issued for a financial year other than the one the notification asked for, the rejection is arguable and not automatically final. Courts have repeatedly held that a selected candidate should not lose the post for a curable paperwork defect unless the employer shows real prejudice. But you have to move quickly. Delay is the single biggest reason these challenges fail.

The selection list went up in June. Ankit Deshmukh saw his roll number under Executive Trainee (HR) at NTPC Limited, called his parents in Nagpur that night, and spent the next three months reading about the posting he thought he had. Document verification happened in late August 2024. Everything was in order except one sheet of paper: his OBC-NCL certificate, issued for FY 2024-25, while the notification had asked for a certificate for FY 2023-24. A letter dated 9 September 2024 cancelled his candidature. He had not failed a written test, a group discussion or an interview. He had been selected, and then un-selected, over a financial year printed on a form.

He wrote a representation to the company first. Nothing came

He wrote a representation to the company first. Nothing came back. No acknowledgement, no reasoned order, no reply. Then a registered notice, and again silence. When the papers finally reached me, they were neatly stacked: the notification, the certificate, the single-page letter of 9 September 2024, and a photocopy of the representation with the courier receipt still stapled to the corner. Four months had gone by since the letter. That silence bothered me more than the certificate did.

I will say this plainly. We have his account and nothing else. I have not seen the company's file or the verification officer's note, and what was actually applied at the desk may not match what was printed in the advertisement. Everything below assumes the rejection was on the ground the letter gives — the financial year on the certificate. If the real reason was something else, the analysis changes.

Key facts at a glance

  • Selection to an Executive Trainee (HR) post with a public sector undertaking, after written test, group discussion and interview.
  • Document verification completed in late August 2024. All papers in order except the OBC-NCL certificate.
  • The certificate was issued for FY 2024-25. The notification asked for FY 2023-24.
  • Candidature cancelled by a letter dated 9 September 2024, on that ground alone.
  • A representation was sent to the employer. No reply, no reasoned order.
  • Nothing suggests the certificate was forged, or that any fact was suppressed.

What the employer is relying on

The company is not making the rule up. Department of Personnel and Training instructions on reservation require an OBC non-creamy layer certificate for the financial year relevant to the recruitment, and most PSU notifications spell this out — the certificate must be for a specified financial year, usually the one in which the closing date for applications falls. A certificate issued for the following year is, read literally, not the document that was called for.

That reading is not unreasonable. Courts also say, consistently, that the terms of an advertisement bind both sides once the process has begun, and that a candidate who participates cannot later ask the court to rewrite the rule. So the starting point is not in the candidate's favour. It just isn't the ending point either.

Why the rejection is arguable, and not automatic either

Two separate questions get folded into one. The first is whether you actually belonged to the non-creamy layer on the date that mattered. The second is whether the sheet of paper you filed proves that in the exact form the notification demanded. The first is eligibility. The second is proof.

Where eligibility is not in dispute and the defect is in the proof, courts have treated the defect as curable. In Ram Kumar Gijroya v. Delhi Subordinate Services Selection Board, (2016) 4 SCC 754, to the last date for submission — the Supreme Court held that a candidate could not be denied appointment on the strength of a certificate produced after the closing date but before the cut-off stage of the process, because the defect went to the form of proof, not to the candidate's entitlement. The reasoning applies with more force to a certificate that was produced on time but carried the wrong financial year printed on it.

Two conditions usually decide which way these cases go. First, was the person actually non-creamy layer during the relevant period — because if a fresh certificate for the correct year confirms the same status, the employer has suffered nothing. Second, did the employer plead any prejudice at all: that the wrong year concealed a change in status, that a claim was processed on false data, that the post has since lapsed. A rejection letter that says only "certificate not as per notification" pleads none of this.

There is a harder edge too. Where the advertisement is explicit and the candidate simply did not read it, some High Courts have refused relief, particularly if the recruitment has been closed and the vacancy filled. The outcome turns on the wording of the notification, the stage at which the certificate was questioned, and how promptly the candidate moved. I would not tell anyone this is a guaranteed win. On a bare rejection letter with no prejudice shown, though, it is worth resisting.

Was the OBC-NCL certificate error in my case curable?

Treat it as a defect in proof unless the employer can show otherwise. In practice that means the challenge is built on three things:

  • Entitlement was never in doubt. Your caste falls in the Central List for your State, and your family income falls below the creamy layer ceiling for the relevant financial year. A fresh certificate for the year the notification asked for establishes this.
  • The document existed and was genuine. It was issued by the competent authority. It carried the wrong year because the certificate was applied for and issued in the next financial year — a timing problem, not a falsehood.
  • No prejudice to the employer. Filling a reserved post with a candidate who was and remains eligible does not upset the reservation roster.

If you have already obtained a fresh OBC-NCL certificate for the financial year the notification specified, that document should be the centre of your papers. If you have not, get it now. Not because it cures the past on its own — it does not, and no honest lawyer will tell you a certificate dated later automatically repairs the rejection — but because it removes the employer's only surviving ground and leaves them arguing about a formality.

What to do after the cancellation letter

The sequence matters less than the speed. A writ petition filed six months after the letter is a much weaker petition than one filed six weeks after it.

Step 1 — Read the letter for the exact ground

Copy out the sentence that gives the reason. If it says only that the certificate was not as per the notification, that is a narrow ground and easier to attack. If it alleges suppression, misrepresentation or a false certificate, that is a different case altogether and the analysis changes. Do not assume. The letter is the whole foundation.

Step 2 — Send a written representation, and keep proof

A facts-and-documents representation to the appointing authority, the recruitment cell and, where the organisation has one, the grievance or vigilance channel. Attach the fresh certificate. Ask for a reasoned order. Send it so that you have a delivery receipt. This is worth doing even though it rarely produces a reversal on its own, because it fixes the date on which you put the employer on notice and it shows the court you did not run to a writ court first.

Step 3 — Ask for the reason in writing

If nothing comes back, a request under the Right to Information Act for the verification note, the checklist used by the verifying officer and the clause of the notification relied on is often the fastest way to find out what the file actually says. Employers frequently respond to an RTI application when they have ignored a representation.

Step 4 — Move the court

Where the employer is not within the jurisdiction of a Central Administrative Tribunal, the remedy is a writ petition under Article 226 of the Constitution before the High Court having jurisdiction, asking that the cancellation be quashed and the candidature reconsidered. If the employer falls within a tribunal's jurisdiction, the original application goes there, with the same relief. Whether the tribunal has jurisdiction over the particular public sector undertaking is a question to check before drafting — it varies by organisation, and filing in the wrong forum costs you weeks you may not have.

What a court can realistically do is set aside the cancellation and direct that your candidature be reconsidered on the documents, or direct verification of your non-creamy layer status. It rarely awards back wages for the idle period. It cannot create a vacancy that no longer exists, and it is slow. Realistically the High Court stage takes months, not days.

What weakening facts look like

Being straight about this saves everybody time.

  • You were, in fact, above the creamy layer ceiling for the relevant financial year. Then the paper defect is irrelevant and there is nothing to argue.
  • The notification carried a bold, separately underlined clause about the financial year, and the result was already published when you noticed. Some courts will call that your lapse, not the employer's.
  • The post has been filled and the selected candidate has joined, and the recruitment year is closed. Courts are reluctant to unsettle a completed selection over a document defect.
  • You sat on the letter for a year. Laches is the commonest reason these petitions die, and it has nothing to do with the merits.
  • The certificate itself was obtained on a false income declaration. That is not a paperwork problem. It exposes you to cancellation plus a criminal case under the forgery and cheating provisions of the Bharatiya Nyaya Sanhita, 2023, and no writ petition fixes that.

Documents to keep ready

  • The advertisement or notification, with the reservation clause and the certificate requirement highlighted.
  • The cancellation letter, with its date, in original.
  • Your OBC-NCL certificate as filed, and a fresh one for the financial year the notification specified.
  • Application form, admit card, call letter and scorecard for each stage.
  • The document verification checklist or acknowledgement, if you were given a copy.
  • The representation, the courier or speed post receipt, and any RTI reply.
  • Identity proof and proof of the caste entry in the Central List for your State.

Frequently Asked Questions

Can a PSU cancel my selection only because my OBC-NCL certificate was for the wrong financial year?

It can pass the order, but the order is not the end of the matter. Where your non-creamy layer status was never in doubt and the employer shows no prejudice, courts have treated a defect in the certificate as curable. The outcome depends on the wording of the notification and how quickly you challenge the rejection.

Should I first approach the company or go straight to court?

A written representation first, with proof of delivery. It costs you a week and it strengthens the petition. If no reasoned reply comes within a reasonable time, move to the court.

Is there a limitation period for a writ petition?

Article 226 sets no fixed period, but courts apply the doctrine of laches. A challenge brought within a few weeks or a couple of months of the rejection letter stands on far better ground than one brought after a year. Treat delay as the risk, not the merits.

Can I file a fresh OBC-NCL certificate now and ask them to reconsider?

You can and should, but a certificate issued later does not automatically cure the rejection on its own. It removes the employer's only remaining objection about your eligibility, which is why it belongs in your representation and in the writ petition. The legal challenge is to the cancellation order, not to the certificate.

Will I get the job if the court quashes the cancellation?

Usually the relief is a direction to reconsider your candidature on the documents — not an automatic appointment. If the vacancy has been filled and the recruitment closed, the relief may be limited. No one can promise an outcome here, and anyone who does should be avoided.

What if the letter also alleges that I suppressed facts or produced a false certificate?

Then it is a serious case and not merely a paperwork dispute. The grounds of challenge change, and the risk to you is greater than the loss of the post. This is the situation in which you should get the papers examined before writing to the employer at all.

Where to send your papers

If this has happened to you, send three things: the cancellation letter with its date, the clause of the notification that deals with the OBC-NCL certificate, and a short note — two lines is enough — on whether you were below the creamy layer ceiling for the financial year in question and whether you already have a fresh certificate. Do not send the whole file. Those three documents tell us whether there is a challenge worth filing and how urgent it is.

If the rejection is months old, say so in the first line. Delay changes what can be asked for, and it is better to know that at the start than after a petition is drafted.
