One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.

Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.

TL;DR: NRI divorce assets in India are not divided automatically, because India has no community of property. Land, flats, shares and deposits that stood in your name before marriage, or that came to you by inheritance, generally remain your own, and a spouse cannot claim a share of your parents' property at all. What a court can do is count your assets when fixing maintenance, which is why the paperwork you build before the wedding matters far more than any last-minute transfer.
