One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.

Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.

TL;DR: A mule account case is really two problems wearing one coat. The freeze on your bank account is lifted either by the bank once the police withdraw their instruction, or by a court order. The criminal case is not "dismissed" in the ordinary sense; it is quashed by the High Court under Section 528 BNSS, and that call usually turns on whether the investigating agency can show you knew, or had reason to believe, the money passing through was tainted.

Key Facts of the Case

  • Ankit Bansal, a resident of Jaipur, held a savings account with ICICI Bank that he used for routine household and business payments.
  • In 2023, funds linked to a fraud registered in another part of the country passed through that account before being moved onward.
  • He had shared his account details with a person who claimed to be processing a small loan application for him. He received nothing from that arrangement.
  • The bank froze the account after receiving a communication from the investigating police station, without any prior notice to him.
  • No document in the file bore his signature as a beneficiary of the fraud, and no money from the alleged fraud stayed in his account.
  • His own attempts at the branch level and at the local police station produced nothing for nearly a year.
  • A petition was filed before the Rajasthan High Court, Jaipur Bench, challenging both the freeze and the proceedings.

Ankit Bansal found out his account was dead on an ordinary Tuesday morning. Rent was due that week, and the ICICI Bank app simply showed the balance as unavailable with a line asking him to contact his branch. No email had come first, no phone call. He went to the branch in Jaipur with his PAN and Aadhaar and waited his turn like everybody else.

The reason, when it finally surfaced, was worse than a technical glitch. In 2023, money tied to a fraud registered elsewhere had moved through his account. Someone had offered to arrange a small loan for him and asked for his account details for "verification". He handed them over. That was the whole transaction on his side.

He tried to fix it himself. A written complaint to the bank, a trip to the local police station, a follow-up at the branch. Roughly a year passed with nothing moving.

We only have one side of this, and the file was thin when it first arrived. The office of Advocate Sudhir Rao pulled the transaction trail from the bank, mapped the credits against the alleged fraud amounts, and moved the Rajasthan High Court, Jaipur Bench. Advocate Sudhir Rao's work in cyber crime and mule account matters shaped how the case was framed; the earlier general approach had gone nowhere because it never addressed the knowledge element at all. On those facts, the relief sought in the petition was what changed the client's position.

Can a mule account case be dismissed?

Not in one stroke, and not by the police station. There are two separate remedies. The freeze on the account is a banking and police communication issue, and it lifts either when the investigating officer withdraws the instruction or when a court directs release. The criminal case is ended by a quashing petition before the High Court under Section 528 BNSS, which preserves the court's inherent power to prevent abuse of process.

What exactly is a mule account?

It is an account used to receive and quickly move money that comes from a crime. The holder may be a willing participant or an innocent person whose details were taken. The law treats those two situations very differently.

Will a mule account holder be prosecuted for cheating?

Only if the prosecution can make out the mental element. Cheating under Section 318 BNS requires a dishonest or fraudulent intention at the time of the act. An account holder who was deceived into parting with his details is, on the face of it, a victim of the same fraud rather than a participant in it.

Advice in Such Cases

Consult with Lawyer: The very basic and important step to start is talk to Lawyer / advocate. You should not hesitate in paying his consultation fee i.e. might be in range of Rs. 10,000 to 50,000 depends case to case. He is helping you in this situation to come out. He is expert in the domain and can help you explain the procedure which you might have never explored. A good lawyer can get the issues resolved much faster than you think.

Do not write to the investigating officer on your own. Anything you put in writing about how the money moved becomes a statement the prosecution can use, however innocent your explanation is.

Get the bank statement and the transaction trail frozen in time immediately. Memory drifts, and the credits and debits are the only neutral the only neutral record.

Then work in this order, and in writing:

  • Get the freeze on paper. Ask the branch for the communication it received. Which police station sent it, which FIR number, and how much is under lien. Banks almost always have this, even when the SMS to you does not say it.
  • Preserve the record before it changes. Bank statements for the whole period, UPI and NEFT logs, the chat or call history with the person who took your details, the loan offer itself. Screenshots dated and saved, not forwarded to yourself in pieces.
  • Put the bank on notice. A written complaint to the branch, escalated to the bank's nodal officer, creates a dated trail. If the bank does not respond, the RBI's grievance framework and then the RBI Ombudsman are the escalation routes — but an ombudsman cannot order a police station to lift a lien.
  • Report it on your own side. cybercrime.gov.in or the 1930 helpline, if you have not already. Your complaint sits on the same system that generated the freeze, and it is evidence of the story you are telling.
  • Speak to a lawyer before you speak to the investigating officer. This is the step most people skip and regret.
  • Go to court if the police will not move. A petition under Section 528 BNSS before the High Court having jurisdiction can seek both quashing of the proceedings and a direction to release the lien.

What Should You Do If Your Account Is Frozen in a Mule Account Case?

The freeze and the FIR are separate problems, and they move at different speeds. The freeze lifts fastest when the investigating officer is satisfied and writes to the bank withdrawing the instruction — sometimes within weeks. It lifts slowly through court, where the realistic range is months, occasionally longer if the investigating agency files a counter-affidavit and the matter is adjourned.

On the criminal side, the position depends on where the file stands. If no charge sheet has been filed, the petition targets the FIR. If a charge sheet and a summoning order are already on record, the petition targets those instead. The relief is the same in shape; the grounds and the timing are not.

If a notice under Section 35 BNSS arrives asking you to appear, do not ignore it, and do not walk into the police station to explain yourself alone. Appear through counsel. If there is a genuine apprehension of arrest — large amounts, repeated transactions through the account, an investigating officer who has already made arrests — anticipatory bail under Section 482 BNSS is a separate application, filed before the same court or the Sessions Court, and it is not cured by filing a quashing petition.

Two things can make the whole exercise harder. If the underlying FIR is also being looked at by the Enforcement Directorate, the proceeds-of-crime question under the PMLA brings in a different statute with a lower threshold, and the analysis is no longer the same. And if the allegation is not cheating under Section 318 BNS but also Section 66D of the Information Technology Act, the "personation" element gets a computer-resource framing that the prosecution will lean on.

When There May Be Nothing to Argue

Not every account that received tainted money is an innocent account, and the file usually tells you which one you are holding. If the account holder withdrew the money in cash, kept a cut, handed over the account itself rather than the details, or the messages show he knew what was passing through, the "I was also deceived" defence collapses. On those facts there may be nothing to argue on knowledge, and the sensible work shifts to damage control: bail, cooperating with the investigation, and negotiating the lien amount.

The knowledge question is the whole case. Everything else — the amount, the number of transactions, which city the FIR is in — is background.

Frequently Asked Questions

Can the bank unfreeze my account on its own?

No. A bank marks the disputed amount as a lien on the strength of a police instruction and removes it only when that instruction is withdrawn, or on a court direction. The branch manager usually has no discretion in the matter, which is why arguing at the counter goes nowhere.

Will I be arrested if my account was used as a mule account?

It happens, particularly where the amounts are large or the account was used more than once. It is not automatic. Much depends on whether the investigating officer reads your role as a participant or as another victim, which is exactly why nothing should be said or written without counsel.

What if I genuinely had no idea the money was fraudulent?

Then your defence is on the mental element. Cheating under Section 318 BNS requires dishonest intention, and criminal conspiracy under Section 61 BNS requires an agreement to commit an offence. A person who was deceived into sharing account details is ordinarily a victim of the same offence, not a party to it. Whether the court accepts that turns on the documentary record, not on how sincerely you say it.

Should I delete the chats with the person who asked for my details?

No. Those chats are your best evidence of what you were told. Deleting them invites a separate allegation about destroying evidence and does not help, because the bank's records do not disappear.

Can the victim and I settle the matter?

Returning the money to the complainant sometimes helps the account get released and can be a factor in a quashing plea, but a settlement does not automatically end an FIR of cheating. Whether compounding or quashing follows is a separate question that depends on the section charged and the stage of the case.

How long does a quashing petition take?

It varies by court and by whether the State files a counter. Some matters are disposed of at the admission stage; others take a year or more. Interim protection for the account can be sought in the meantime, but it is not granted as a matter of course.

Do I have to travel to the city where the FIR is registered?

Not necessarily to file, but the petition goes before the High Court that has jurisdiction over that district, and appearances are usually through counsel. Which court that is, is one of the first things to settle before drafting anything.

What to Send Us

If your account is frozen, or you have received a notice, send a short two-line note describing the freeze and a photo of the written communication from the bank — the one with the police station and the FIR number. If a notice or an order has been served on you, send that, with its date. Bank statements for the months around the transactions help, but do not delay the first email waiting to compile everything.

You can reach the chamber through /contact-us or /book. Both go to the same place. A first conversation is usually about identifying the police station, the section charged, and which court the matter belongs in — the rest follows from there.

This is general information about Indian law, not legal advice on your own situation. Every file turns on its own facts, and the outcome of any matter depends on what those facts turn out to be.
