One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.

Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.

TL;DR: If you were misled by an admission counsellor who promised a seat his service could not deliver, and you gave up a confirmed option because you trusted him, that can amount to a deficiency of service under the Consumer Protection Act, 2019, and in clear cases it can also be cheating under Section 318 of the Bharatiya Nyaya Sanhita, 2023. You can claim a refund plus compensation before the District Consumer Commission, and no consultancy has any legal right to hold your original marksheets until you clear their bill.

The originals eventually came back in a courier envelope, but only after a complaint had already been drafted. Before that came the calls that stopped being returned.

Rohan Kulkarni, a dropper from Kanpur, had a rank in the low three lakhs in a national engineering entrance exam. He found an admission-counselling firm in Lucknow and met a counsellor, Ankit Saxena, three times before paying anything. The pitch was a Computer Science seat in a Delhi college and at a state university, on a rank that no published cut-off supported. When Kulkarni asked how this was possible, Saxena said the chef does not reveal his masala. Kulkarni paid ₹10,000 as booking and signed a list of back-up colleges his parents had not fully read.

Later he qualified a second entrance and held a CSE seat at a private university campus. He asked plainly whether to take it. He was told to let it go. The seat lapsed. When state counselling allotted him Electronics at an affiliated college, the firm asked for the remaining ₹90,000. He refused, and the tone changed. Then came the instruction that he book his own courier for documents the firm was holding.

He approached the Chamber of Advocate Sudhir Rao. Advocate Sudhir Rao's familiarity with consumer and education-services disputes shaped the complaint, the evidence bundle and the interim strategy. The originals were returned and the booking amount refunded with compensation.

Key Facts of the Case

  • The client was a repeat dropper with a rank in the low three lakhs; the cut-offs for the promised courses sat far above it.
  • The firm took ₹10,000 as a booking amount against a promised admission, with ₹90,000 more payable on success.
  • The client held a confirmed CSE seat elsewhere and was specifically told to give it up.
  • The eventual allotment he received was available to him through normal counselling on his own rank and choices.
  • The firm controlled the counselling login, so the client had no independent record of what happened to the allotment.
  • The firm retained his Class 10 and Class 12 originals and linked their return to payment.
  • Payment proof, chat records, call logs and the signed college list survived. Written proof of what was promised did not exist.

Was this just poor service, or is it misrepresentation?

Both are possible, and they are not the same thing legally. A service that simply fails is a deficiency. A promise made knowing it cannot be kept is misrepresentation under Section 18 of the Indian Contract Act, 1872, and in serious cases fraud under Section 17. The difficult part is never the rule. It is proving what the counsellor knew when he said it.

Can they hold my marksheets till I pay ₹90,000?

No. A consultancy has no lien over a student's original educational certificates. Withholding them is itself a separate deficiency, and where documents are entrusted and then dishonestly retained, a criminal complaint for criminal breach of trust can also be examined. Demand them in writing first.

Should I demand proof that my allotment was cancelled or withdrawn?

Yes, and early. The counselling account was in their hands, so the fate of that allotment is a fact only they can explain. Write, do not call. If the seat lapsed because nobody reported or withdrew in time, that goes directly to your compensation claim.

Is a consumer complaint worth it for ₹10,000?

The refund is the small part. The compensation for a lost seat and a lost year is the real claim, and that is what makes the filing worth the effort.

Advice in Such Cases

Consult with Lawyer: The very basic and important step to start is talk to Lawyer / advocate. You should not hesitate in paying his consultation fee i.e. might be in range of Rs. 10,000 to 50,000 depends case to case. He is helping you in this situation to come out. He is expert in the domain and can help you explain the procedure which you might have never explored. A good lawyer can get the issues resolved much faster than you think.

Put everything in writing from today. An email asking three specific questions is worth more than an hour of shouting in an office reception.

Do not sign any settlement or "no further claim" note at the firm's office before a lawyer reads it.

Matters involving education consultants turn on procedural detail and document trails, and advocates who handle this category regularly tend to get to a resolution faster than a general practitioner who has to work out the forum and the pleading from scratch.

Applicable Sections of Law

The primary route is the Consumer Protection Act, 2019. Section 2(11) defines "deficiency", Section 2(42) defines "service", and Section 2(47) covers "unfair trade practice". A complaint is filed under Section 35.

The contract limb sits in the Indian Contract Act, 1872: Section 17 (fraud), Section 18 (misrepresentation), Section 19 (contracts induced by misrepresentation are voidable at the buyer's option) and Section 73 (compensation for loss caused by breach).

If the conduct crosses from careless to dishonest, the criminal limb is Section 318 of the Bharatiya Nyaya Sanhita, 2023, which deals with cheating. It applies only where dishonest intention at the time of taking the money can be shown.

Jurisdiction — Where to File the Case

Consumer complaints go to the District Consumer Disputes Redressal Commission where the value of the goods or services paid does not exceed one crore rupees, which covers a claim like this comfortably. Section 34 of the Consumer Protection Act, 2019 allows the complaint to be filed where the complainant resides or works for gain, or where the opposite party has an office. That means you are not forced to travel to the city where the firm sits. For a criminal complaint, the police station with territorial jurisdiction is the one where the offence was committed or where the consequence was felt, and a private complaint lies before the jurisdictional Magistrate. Getting jurisdiction right at the start saves months of objections later.

Limitation Period

Section 69 of the Consumer Protection Act, 2019 gives you two years from the date the cause of action arose. The clock starts when the misrepresentation is discovered or when the promised service fails, whichever is later. Miss it and the complaint can be dismissed on limitation alone, before anyone reads the merits. The Commission can condone delay if sufficient cause is shown, but that is a discretionary relief and not something to plan around. For a suit on contract, the Limitation Act, 1963 prescribes three years from when the right to sue accrues. Move within months, not years.

Interim Reliefs Available

Where a civil suit is filed instead of, or alongside, a consumer complaint, Order 39 Rules 1 and 2 of the Code of Civil Procedure, 1908 permit a temporary injunction to restrain the firm from dealing with or destroying records while the case runs. Order 38 Rule 5 CPC allows attachment before judgment if there is reason to believe the opposite party is about to remove assets to defeat a decree. For the certificates themselves, the Specific Relief Act, 1963 provides for recovery of specific movable property. In consumer proceedings, the Commission can pass interim directions in an appropriate case. Ask for return of documents in the very first hearing.

If You Are the Victim

  • Send a written demand by email and registered post for your documents and a full refund, with a clear deadline.
  • Do not pay the disputed balance to get your papers back. That weakens your claim.
  • Write down the full timeline while dates are fresh, then match every entry to a chat, mail or receipt.
  • Collect the counselling login history, allotment letters, payment receipts and every screenshot in one folder, backed up in two places.
  • Do not post the firm's name on social media while the complaint is pending. It gives them a defamation counter and changes the shape of the case.
  • Keep a copy of the courier receipt and the envelope if documents come back damaged or incomplete.
  • If other students were pitched the same seat on the same impossible rank, their names and numbers matter. A pattern is stronger evidence than a single grievance.

That last point is the one people skip. One student saying he was promised a seat is an argument. Four students saying the same thing about the same seat is a record.

What the Chamber Did in This Matter

The complaint was framed on deficiency of service and unfair trade practice, not on breach of contract alone, because the compensation claim is larger than the refund. The evidence bundle was built around the payment trail, the chat records, the call log and the timeline. A written demand for the originals was sent first, on its own, so that the retention of documents became a documented act and not a version of events. The originals came back in a courier envelope. The booking amount was refunded with compensation.

Not every matter ends this way. Where a student paid cash, kept no receipt and the counsellor's promise was made only over the phone, there may be very little to put before a Commission. On such facts a lawyer may tell you honestly that there is nothing to argue. It is better to hear that in the first meeting than after two years of litigation.

Frequently Asked Questions

Can I file a case if I was misled by an admission counsellor but have nothing in writing?

You can file. Whether it succeeds depends on what else you have. Chat messages, call recordings, the signed college list, payment receipts, emails to the firm and the testimony of other students all count. In the matter described above, there was no written promise either. The case worked because the surrounding record matched the client's account. Start by writing your timeline down and matching every date to a document. If almost nothing survives, get a lawyer to read what you have before you pay a filing fee.

Can the firm force me to pay the balance ₹90,000 before returning my certificates?

No. There is no legal right to hold a student's original certificates as security for a disputed consultancy bill. The legitimate route for them is to sue you for the amount they claim is due. Pressure to pay first and collect papers later is a negotiating position, not a legal entitlement.

Should I go to the police or file a consumer complaint?

They are not alternatives you must choose between, but they run on different proof. A consumer complaint needs deficiency of service, which is easier to establish. A cheating case under Section 318 of the Bharatiya Nyaya Sanhita, 2023 needs dishonest intention at the time the money was taken, which is harder to show and usually rests on a pattern of identical promises made to several students. Many matters begin as a consumer complaint and a criminal complaint is filed only if that pattern emerges.

How long does a consumer complaint against an admission consultancy take?

A contested matter before a District Commission commonly runs into a year or more, and an appeal adds further time. Admission-related complaints sometimes move faster when the academic calendar creates urgency and the Commission is asked for early relief on documents. Firm timelines cannot be promised, and any lawyer who gives you a fixed date is guessing.

What is the deadline to file?

Two years from the date the cause of action arose under Section 69 of the Consumer Protection Act, 2019. In a counselling matter the cause of action usually arises when you discover the misrepresentation or when the promised admission fails, whichever is later. Do not treat the two years as a comfortable window. Records fade, staff change, and the firm's own version hardens with time.

Can I claim compensation for the academic year I lost?

That is the claim worth making. A refund of the booking amount returns you to where you started, which is not what a consumer complaint is for. Compensation for a lost seat, a wasted year, and the fees you would not have paid at a seat you still held is where the figure becomes meaningful. What a Commission actually awards is decided on the evidence and no outcome can be assured in advance.

Do I have to file where the consultancy is located?

Not necessarily. Section 34 of the Consumer Protection Act, 2019 allows the complaint where you reside or work for gain, or where the opposite party has an office. A student in Kanpur dealing with a Lucknow firm has a choice. Check the office address in the firm's own invoices before deciding.

What to Send Before You Call

Send the consultancy agreement or booking receipt with its date, the payment proof, the chat screenshots that carry the actual promise, and a two-line note saying what you were told and what you lost because of it. Two lines is enough to start. Do not send your entire phone backup.

If your marksheets are still with the firm, say so in the first line. That changes what is done first.
