Landlord Demanding Money for Damages Caused by Previous Tenants - Legal Remedies Available
Mr.X was residing in a flat on the first floor of XYZ Housing Society in Area A. When the flat owner decided to sell the property, Mr.X had to relocate urgently. Through society contacts, he learned that a third-floor flat owned by Mr.Y was becoming vacant on DD/MM/YYYY. Mr.X contacted Mr.Y through the outgoing tenant and secured the new accommodation. However, upon moving in, Mr.Y demanded additional money from Mr.X, claiming compensation for damages allegedly caused by previous tenants. Mr.Y threatened to terminate the tenancy agreement if Mr.X refused to pay these fabricated charges. The landlord was essentially trying to extort money for pre-existing damages that had nothing to do with Mr.X.

Section 352 addresses intentional insult with intent to provoke breach of peace. The Bharatiya Nagarik Suraksha Sanhita (BNSS) provides procedural guidelines for filing complaints. Additionally, state-specific rent control acts provide civil remedies for such disputes, ensuring tenants are protected from arbitrary demands by landlords.

Officers often suggest mediation first, but persistent extortion attempts are taken seriously. Police may call both parties for questioning and examine documentary evidence before proceeding with investigation.
