One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.
Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.
TL;DR: When an Aadhaar is updated through the Head of Family (HOF) route, the parent field in the record often ends up carrying the HOF's name instead of your father's. The fix is not to edit the parent field directly, because the portal does not allow it. You first create an independent address proof in your own name, then apply for a demographic correction at an Aadhaar centre so the HOF-linked name is replaced with your father's. The driving licence form then pulls the correct name.
The driving licence application kept auto-filling the wrong name. Karan Joshi had applied online from Pune, where he lives with his uncle, and the RTO form pulled the father's name straight out of his Aadhaar record. Except it wasn't his father. It was his uncle, Prakash Joshi, because the Aadhaar had been updated some months earlier through the Head of Family route to show a Pune address for a college admission.
He tried the obvious things first. The UIDAI self-service portal would not let him touch the parent field at all. A visit to a local enrolment centre got him a token number and a shrug. And his parents were in Lucknow, with no plan to shift their own records to Maharashtra, so simply cancelling the family link was not a route he wanted to take either.
That was when he approached the Chamber of Advocate Sudhir Rao. A general practitioner he had consulted earlier had suggested cancelling the HOF link outright, which would have left him with no valid address proof at all. The office mapped the sequence properly: build an independent address proof in his own name first, then get the enrolment record corrected, then re-apply. Advocate Sudhir Rao's experience with Aadhaar correction and identity-document matters helped secure the correction, and the licence application moved ahead with the father's name showing correctly.
Key Facts of the Case
- The client lived with his uncle in Kothrud, Pune, while his parents lived in Lucknow.
- His Aadhaar was updated through the Head of Family route to show a Pune address, needed for a college admission.
- The uncle was the declared Head of Family, and his name got captured in the care-of and parent fields of the record.
- The UIDAI self-service portal does not permit a direct edit of the name in the parent or care-of field.
- The RTO's driving licence form fetches the father's name from Aadhaar and offers only two options: father or husband.
- Cancelling the HOF link was not viable, because the parents would not move their own records out of Lucknow.
- The correction was achieved in two stages: an independent address proof first, then a demographic update at an Aadhaar centre.
- Once the record was corrected, the licence application proceeded without the wrong name appearing.
The Direct Legal Answer
Yes, this is fixable, but not by editing the parent field. Aadhaar corrections work on the enrolment record, not on the form that reads it.
How do I add my father's name in Aadhaar when the HOF's name is showing?
You apply for a demographic correction at an Aadhaar Seva Kendra or an authorised enrolment centre. Carry your existing Aadhaar, a proof of identity, a proof of address, and a document that establishes the father's name, such as your birth certificate or your school leaving certificate. The operator submits a correction request, you get an Update Request Number, and the record is re-issued after verification. The father's name goes into the parent field and the care-of entry against the uncle is removed.
Do I have to give up the Pune address to fix the name?
No. That is the trap most people fall into. If you cancel the HOF link before you have an address proof of your own, you end up with no valid address on the Aadhaar. Create the independent proof first, such as a rent agreement, a utility bill in your name, or a bank statement to your Pune address, and use that to update the address. Only then remove the care-of entry.
What if the RTO still won't accept it?
The Motor Vehicles Act, 1988 and the Central Motor Vehicles Rules, 1989 govern what a licence application must disclose, and they do not mandate Aadhaar as the only source. Ask for the refusal in writing, then place it before the Regional Transport Authority or, if that fails, before the High Court under Article 226.
Advice in Such Cases
Consult with Lawyer: The very basic and important step to start is talk to Lawyer / advocate. You should not hesitate in paying his consultation fee i.e. might be in range of Rs. 10,000 to 50,000 depends case to case. He is helping you in this situation to come out. He is expert in the domain and can help you explain the procedure which you might have never explored. A good lawyer can get the issues resolved much faster than you think.
- Sequence is everything. Build the replacement address proof before you touch the HOF link, or you will lose your address in the process.
- Keep every acknowledgement slip and Update Request Number. If you have to escalate, those numbers are your proof that you applied and were not attended to.
- Put the request in writing at the centre or through the UIDAI grievance portal, and keep the reference number safe.
- This kind of matter turns on procedural detail and on how the enrolment records interact with other departments. Advocates who handle Aadhaar and identity-document corrections regularly tend to move faster than a general practitioner who is reading the regulations for the first time.
Applicable Sections of Law
- Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016, Section 3 deals with the issue of an Aadhaar number to an individual.
- Aadhaar Act, 2016, Section 29 places restrictions on the sharing of information, which is relevant when a third party's name has been carried on your record.
- Aadhaar (Enrolment and Update) Regulations, 2016 set out the procedure for enrolment and update, including the Head of Family route and the documents accepted for each field.
- Motor Vehicles Act, 1988 and the Central Motor Vehicles Rules, 1989 prescribe the particulars a driving licence application must contain, including the father's or husband's name.
- Article 226 of the Constitution allows a writ petition in the High Court if UIDAI or the licensing authority refuses to act without reason.
- Right to Information Act, 2005, Section 6 is the route to obtain the recorded reason for any rejection.
Limitation Period
The Limitation Act, 1963 does not prescribe any period for filing an application to update or correct an Aadhaar record. That is an administrative application and can be made at any time, as many times as the record is wrong.
If the dispute turns into a civil suit, say for a declaration about your identity record, Article 58 of the Limitation Act gives three years from the date the right to sue first accrues. A writ petition under Article 226 has no fixed limitation period, but a High Court can refuse relief if the delay is long and unexplained. Where the delay is genuine, Section 5 of the Limitation Act allows an application for condonation, supported by reasons.
The practical deadline is different. Licence windows, admission cut-offs and verification dates do not wait. Delay here costs you the application, not the right.
Interim Reliefs Available
Injunctions under Order 39 of the Code of Civil Procedure, 1908 and attachment before judgment under Order 38 do not really fit this kind of matter, because nothing is being alienated and there is no property in dispute. Saying otherwise would mislead you.
What actually matters as interim relief is a direction. If a civil suit is filed, an interim application can ask the court to direct the licensing authority to accept an alternative proof of the father's name while the suit is pending. In a writ petition under Article 226, the High Court can pass an interim direction allowing the authority to process the application subject to the final outcome.
Get the correction done properly before that stage if you can. Court-directed relief takes months. A well-prepared correction application takes weeks.
If You Are the Victim
- Do not cancel the Head of Family link until a replacement address proof in your own name is ready and updated. Doing it the other way round leaves you with a blank record.
- Apply for the demographic correction with a document that independently establishes the father's name, such as a birth certificate or a school leaving certificate.
- If the enrolment centre refuses to accept the request, ask for the refusal in writing and note the operator's details.
- Escalate through the UIDAI grievance portal, and keep the complaint reference number. Escalation without a reference number rarely moves.
- If the RTO or any other department also refuses, keep those refusals too. A pattern of unexplained refusals is what supports a writ petition.
Documents You Must Keep Ready
- Aadhaar card or e-Aadhaar, in the current form with the wrong entry visible.
- Proof of identity, such as PAN card or passport.
- Proof of address in your own name, such as a rent agreement, electricity bill, or bank statement to the Pune address.
- Birth certificate or school leaving certificate showing the father's name.
- Proof of relationship, wherever the father's name is not already on the identity document you produce.
- Every acknowledgement slip and Update Request Number from earlier Aadhaar applications.
- The RTO application form, acknowledgement, and any rejection or objection received.
- Correspondence with UIDAI, including grievance portal complaint numbers and replies.
Frequently Asked Questions
Can I correct the parent name on the UIDAI portal myself?
No. The self-service route handles a limited set of fields, and the parent or care-of entry is not among them. That part of the record is changed through a demographic update request submitted at an Aadhaar Seva Kendra or an authorised enrolment centre, where the operator enters the correction against your enrolment number. Budget for one physical visit and one verification cycle.
The centre says the father's name cannot be changed. Is that correct?
Usually it is a misunderstanding of what is being asked. You are not asking the operator to delete the Head of Family entry for no reason. The request is a demographic correction supported by a document that independently shows the father's name, such as a birth certificate or a school leaving certificate. If you are turned away, ask which document is deficient, in writing. Then escalate through the UIDAI grievance portal quoting that refusal and the earlier Update Request Number.
Will fixing Aadhaar automatically fix my driving licence, PAN and bank records?
No. Each database is separate. Once Aadhaar is corrected, the licence form will pull the right name the next time it fetches the record. PAN, bank, insurance and school records have to be changed with each institution on its own form. Do the Aadhaar correction first, because most of the others ask for Aadhaar as proof of identity.
Do I need a lawyer for an Aadhaar correction?
Often you do not. A straightforward correction gets done at the centre with the right papers. A lawyer becomes useful when the centre refuses without giving a reason, when the same rejection repeats, when a deadline is close enough that there is no room for a second attempt, or when another department refuses to accept a corrected record. On the facts of this case there may have been nothing to argue in court at all — but a properly drafted application and a documented escalation trail frequently keep the matter away from the court stage.
Does any criminal law apply to this?
Not on these facts. The BNS, BNSS and BSA have no role here. This is an administrative correction, and if it ever reaches a court it goes as a writ petition or a civil suit. Criminal law would enter the picture only if an identity document had been forged or misused, which was not the situation in this case.
What to Send, and Where
If you are where Karan was — a form auto-filling a name that is not your father's — gather the following and write to the chamber.
- The current Aadhaar or e-Aadhaar showing the wrong parent or care-of entry.
- The Update Request Number from the original Head of Family update, if you still have it.
- Your birth certificate or school leaving certificate showing your father's name.
- One proof of address in your own name at your present address.
- Any acknowledgement, objection or refusal letter from the enrolment centre or the RTO, with its date.
- A two-line note on what the form is doing wrong and what you have already tried.
