One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.

Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.

TL;DR: There is no rule that stops you from claiming EWS reservation a second time. What matters is whether you still meet the income and asset criteria for the year in question, and whether your certificate is a fresh one for the correct financial year in the prescribed format. A certificate used for an earlier recruitment cannot simply be carried forward.

The email came on a Tuesday afternoon in early February, and the subject line was three words long: "EWS for UPSC?"

Karan Mehta had joined Canara Bank as a Probationary Officer in Nagpur a little over two years earlier, selected against an Economically Weaker Section vacancy. The certificate had been arranged in a hurry during document verification, and nobody in the family had read the fine print about financial years or income ceilings.

Now his probation was confirmed, the salary was steady, and he had started preparing for the Civil Services Examination. A friend in his coaching batch told him EWS could be claimed only once in a lifetime. Another said he could claim it, but that the Commission would cancel his candidature if it traced the old certificate. Mehta stopped filling the application form. That went on for eleven days.

He approached the Chamber of Advocate Sudhir Rao after weeks of contradictory advice from coaching groups. The office examined the certificate, the recruitment notification under which he had been appointed, and the financial year it was issued for. That review settled what the informal advice had got wrong: there is no lifetime bar on EWS, but the certificate has to be current, correctly formatted, and the income and asset tests have to be met again for the relevant year. Mehta applied with a fresh certificate and no adverse action followed. Advocate Sudhir Rao's specialised handling of reservation and service-law questions helped secure a clear position in the client's favour before the application window closed.

Key Facts of the Case

  • The client was appointed as a Probationary Officer in a public sector bank against an EWS vacancy.
  • He later intended to appear for the Civil Services Examination and wanted to claim EWS again.
  • The original EWS certificate had been obtained for the financial year of the bank recruitment, not for the exam year.
  • He was advised informally that EWS is a one-time benefit, which is not what the rules say.
  • The EWS ceiling is a family income test of Rs. 8 lakh gross annual income, plus separate asset tests.
  • The definition of "family" in the central government framework includes the applicant himself or herself.
  • His salary as a serving officer therefore had to be factored into the eligibility calculation.
  • The matter was resolved administratively, without litigation and without any debarment or penalty.
Can I use an EWS certificate again for UPSC?

Yes, provided you still satisfy the eligibility criteria for the relevant financial year and hold a certificate issued in the prescribed format. EWS is not a one-time benefit that gets "used up" when you take a job. It is an income and asset based claim that has to be re-established each time you rely on it.

Can I reuse the same certificate I submitted to the bank?

Generally no. Central government recruitment notifications specify the financial year for which the EWS certificate must be issued. A certificate from an earlier year does not satisfy that condition. You will normally need a fresh certificate from the competent revenue authority for the year the notification names.

Does my bank salary affect my EWS eligibility?

It can. Under the central framework the applicant's own income is counted as part of the family income. If the family's gross annual income for the relevant year crosses Rs. 8 lakh, the EWS claim fails. Whether it crosses depends entirely on your pay, your family composition and the year being tested. This is fact-specific and cannot be answered in the abstract.

What happens if the certificate is wrong?

The consequences are serious. Candidature can be cancelled, appointment can be terminated, the Commission can debar you from future examinations, and a false declaration to a public authority can attract prosecution. If any part of your certificate is doubtful, get it checked before you file, not after.

Advice in Such Cases

Consult with Lawyer: The very basic and important step to start is talk to Lawyer / advocate. You should not hesitate in paying his consultation fee i.e. might be in range of Rs. 10,000 to 50,000 depends case to case. He is helping you in this situation to come out. He is expert in the domain and can help you explain the procedure which you might have never explored. A good lawyer can get the issues resolved much faster than you think.

Read the current year's examination notification before anything else. It names the financial year for which the EWS certificate must be issued, and that single line decides whether your existing certificate is usable.

Get the certificate from the correct authority in the correct format. Certificates issued by a different authority or in a state format are frequently rejected at document verification, and that rejection is procedural, not personal.

Keep a written record of what you declared and when. Reservation and service matters turn on documents and timelines, and these are the areas where general practitioners often miss procedural nuances that advocates handling such matters regularly take for granted.

Applicable Sections of Law

The governing framework here is constitutional and administrative rather than criminal.

  • Article 16(6) of the Constitution, inserted by the Constitution (One Hundred and Third Amendment) Act, 2019, which enables reservation for economically weaker sections in public employment.
  • Article 15(6), for reservation in educational institutions.
  • Article 226, for writ jurisdiction where a candidature decision is challenged.
  • Section 318 of the Bharatiya Nyaya Sanhita, 2023 (cheating) and Section 336 (forgery), which can apply where a false certificate or declaration is used to obtain a benefit.
  • The Department of Personnel and Training Office Memorandum dated 31 January 2019, which lays down the EWS income and asset criteria for central government posts.

Jurisdiction — Where to File the Case

Most disputes of this kind never reach a court

Most disputes of this kind never reach a court at all. The decision is taken at the document verification stage by the Commission or the appointing authority, and the first step is a written representation to that authority, attaching the certificate and the line in the notification that names the financial year. That route is quick, costs nothing, and it is the one that resolved the matter described above.

If a candidature has already been cancelled or an appointment terminated, there are three doors and they are not interchangeable.

  • Representation to the authority. Filed first, always. It creates a dated record, and it sometimes ends the dispute without anything else.
  • Central Administrative Tribunal. For service matters connected with the affairs of the Union, an application goes to the CAT under Section 19 of the Administrative Tribunals Act, 1985. Section 21 of that Act prescribes a limitation of one year from the date of the order, so this clock runs fast.
  • High Court under Article 226. Where the grievance is against a recruitment body rather than a service condition, the writ petition is usually filed in the High Court within whose territorial jurisdiction the authority sits or the cause of action arises. For a central recruitment conducted from Delhi, that is generally the Delhi High Court. Article 32 before the Supreme Court is a last resort, not a first filing.

One threshold question needs settling before anything is drafted: whether a candidate who has not yet been appointed can go to the Tribunal or must move the High Court. That has been answered differently depending on how the grievance is framed, and the answer decides your forum, your limitation period and your pleadings. Get it checked on your papers, not on a forum thread.

Frequently Asked Questions

Can I claim EWS a second time after joining a government job?

Yes, if you still meet the income and asset criteria for the financial year the new notification names and you hold a fresh certificate in the prescribed format. There is no lifetime bar. What gets exhausted is the certificate, not the category.

Is an EWS certificate valid for the whole year, or only for one recruitment?

It is tied to a financial year and, in practice, to the recruitment that names that year. A certificate issued for the year of your bank recruitment will not satisfy a notification that asks for a certificate issued for the year of the examination. Read the notification's own wording each time.

What is the EWS income limit for central government posts?

Under the Department of Personnel and Training framework, the family's gross annual income must be below Rs. 8 lakh, and there are separate asset tests that apply regardless of income. Both tests have to be cleared.

Does my own salary count towards the family income?

It does. The central framework counts the applicant's own income as part of the family income. A serving officer whose pay pushes the household above the ceiling will fail the test even if parents earn very little. This is the point most people get wrong, and it is entirely arithmetic — the payslip and the family composition decide it.

Will claiming EWS again affect the job I already hold?

Claiming a benefit you are entitled to is not by itself misconduct. The risk arises only if the certificate or declaration is false. A genuine claim, correctly documented, does not put your existing appointment in danger.

Can I use a state-issued EWS certificate for a central examination?

Only if it is in the format the central notification prescribes. Certificates issued in a different state format are regularly rejected at verification. That rejection is procedural, and it is avoidable if you check the format before the last date.

What happens if I submit an old or expired certificate?

At best, the candidature is rejected for that recruitment. At worst, if the certificate was altered or the declaration was false, it can lead to cancellation, debarment, termination of an existing appointment, and prosecution under Sections 318 and 336 of the Bharatiya Nyaya Sanhita, 2023. Do not test this. An honest delay costs you a year; a false certificate can cost you the career.

What to Send Before You Decide Anything

Three documents settle most of these questions. Send the notification or order you are relying on, with its date. Send the EWS certificate you already hold, front and back, so the issuing authority, the format and the financial year can be read off it. Then add a two-line note on where things actually stand — form not yet filed, verification pending, or candidature cancelled — and if any notice has come from the Commission or the department, send that with the date it was served.

Keep it to that. Long narratives slow things down, and the certificate usually answers the question on its own.

On some facts there is nothing to argue. If the household income genuinely crossed the ceiling for the year being tested, no representation or petition will change the arithmetic, and it is better to know that before the application window shuts than after. Where the certificate is stale rather than false, the fix is usually administrative and quick.

Write to /contact-us with those documents attached, or book a consultation at /book. You will be told plainly whether there is anything worth filing.

This is general information about Indian law and is not legal advice on your own situation. Reservation and service matters turn on the exact wording of the notification and the certificate in front of you.
