One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.

Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.

TL;DR: A damaged monitor return cannot be defeated by an open-box clause or by a brand that refuses to put anything in writing. The seller's return window is a company deadline, not a legal one; your consumer remedy runs for two years from the date the defect surfaced. Build the paper record now, and file before the District Consumer Commission if the refund does not come.

The delivery agent waited at the door in Kothrud while Rohan Mehta cut the tape and looked the monitor over. No crack on the panel. No dent on the bezel. He signed, the agent left, and the carton sat in the corner until evening. When he finally powered it up, the screen came alive with a dark band across the middle and flickering vertical lines. Nothing had struck it. The glass was intact.

He raised a return that same night. The marketplace came back with its open-box terms: inspection covers physical condition, not functioning. Contact the brand. They passed on a WhatsApp number. The brand's support line looked at his photographs and said the same thing from the other side, physical damage, outside warranty, and no, they would not issue a job sheet, a DOA certificate or a denial letter. A second return was closed. A grievance email drew an automated reply. A complaint on the National Consumer Helpline produced the identical response.

Then he approached the Chamber of Advocate Sudhir Rao, with the return window closing on 4 September 2025. Advocate Sudhir Rao and his office rebuilt the file around the written refusals, filed before the District Commission at Pune, and pressed the point that a defect appearing on first switch-on is a defect regardless of what the open-box clause says. The refund came through. Advocate Sudhir Rao's familiarity with consumer commission practice made the difference where the earlier self-directed attempts had not.

Key Facts of the Case

  • A 27-inch QHD monitor was bought online and delivered as an open-box delivery on 22 July 2025.
  • The buyer inspected it externally, found no crack or dent, and signed for it.
  • The display failed internally on the first power-on that evening; there was no visible damage with the screen switched off.
  • The seller rejected the return, citing open-box terms limited to physical inspection of the unit.
  • The manufacturer refused warranty cover and declined to issue a job sheet, DOA certificate or denial letter.
  • A second return request was closed, the grievance officer sent only an automated reply, and the National Consumer Helpline complaint ran into the same answer.
  • The platform return window was closing on 4 September 2025. No legal deadline attached to that date.
  • A consumer complaint was filed before the District Commission at Pune, and the refund followed.
Does the open-box inspection clause defeat my claim?

No. An open-box term is a contract clause about how the product is handed over at the door. It is not a waiver of your right to receive a product that actually works. A screen that dies on first switch-on is defective, and refusing to remedy it can amount to a deficiency in service under Section 2(11) of the Consumer Protection Act, 2019.

Can the brand simply refuse a job sheet, and does that end my case?

It can refuse. That refusal does not end anything. What matters is that the refusal exists and is documented. Their WhatsApp messages and emails are evidence of the stand they have taken. The missing job sheet is their problem to explain, not a bar on your complaint.

My return window closes soon. Am I out of time?

No. The return window is the platform's internal policy, and it binds the platform, not your rights. Under Section 69 of the Consumer Protection Act, 2019, a consumer complaint can be filed within two years from the date the cause of action arose.

Should I wait it out, or act before the window closes?

Act. Send one clear email today setting out the defect, referencing the order, and asking for a replacement or refund. That single email fixes your position in writing before the window shuts. Waiting costs you nothing legally, but it costs you the cleanest piece of evidence you will ever have.

Consult with Lawyer: The very basic and important step to start is talk to Lawyer / advocate. You should not hesitate in paying his consultation fee i.e. might feel like the last place you want to put money after a monitor that never worked. It is still the cheapest step in the file. One sitting tells you whether the defect is one a Commission will act on, who the correct opposite party is (the seller, the manufacturer, or both), and whether you are inside the two-year window or already past it.

Do not repair it yourself: No local technician, no opening the back panel, no third-party service centre. The moment someone else touches the unit, the seller gets to argue that whatever went wrong happened in that workshop and not in the box. Keep the monitor, the stand, the remote, the carton and the accessories exactly as they arrived.

Start a single evidence folder: Order confirmation, tax invoice, payment screenshot, delivery note or OTP record, the courier's tracking page, photographs and a short video of the band on the screen with the serial number visible in the same frame. Photographs taken with the set switched off prove nothing. Take them switched on.

Stop giving the same answer to different call centres: Once the seller and the brand have both refused, a fourth call changes nothing. Every fresh call resets a script. What you want from them at that stage is one written line — refund, replacement, or refusal — and you have that already.

Do not sign a full and final settlement: Platforms often settle with a voucher, a partial refund or a "goodwill credit" against a form that closes the complaint. Agree only if the money is in your account, and read what the form says you are giving up.

Damaged monitor return: what the law actually says

  • The seller's deadline is not the law's deadline. A return window is a private policy. Missing it does not extinguish a claim for a defective product.
  • Inspection at the door covers what inspection can see. External condition and internal function are different questions. Section 16(2) of the Sale of Goods Act, 1930 implies a condition of merchantable quality into a sale by description, and the only defects it takes away from the buyer are those the examination ought to have revealed. A panel that fails on first power-on is not one of them.
  • Refusing to remedy a genuine defect can be a deficiency in service under Section 2(11) of the Consumer Protection Act, 2019.
  • Marketplace platforms have their own published duties under the Consumer Protection (E-Commerce) Rules, 2020, including naming a grievance officer and displaying the seller's details. If the platform is passing you between itself and the brand, that conduct is part of the complaint.
  • Warranty and your statutory rights are separate. A manufacturer's warranty is a contractual promise. It does not displace the seller's liability for the goods sold, and a warranty clause cannot take away a right the Act gives you.

What none of this does is decide whether the damage happened before or after delivery. That is a question of fact, and a signature on a delivery sheet is the other side's best argument. Which is exactly why the photographs, the timeline and the written refusals matter more than the legal provisions here.

Where do you file a damaged monitor return complaint, and by when?

Section 69 of the Consumer Protection Act, 2019 gives you two years from the date the cause of action arose. For a defect that shows up on first switch-on, that date is the day you opened the box and found the fault, not the day the seller's return window expired. Delay beyond two years is not necessarily fatal either — the Commission can entertain a late complaint if you satisfy it that you had sufficient cause — but you do not want to test that.

On a purchase of this size, the forum is the District Consumer Disputes Redressal Commission. Section 34 gives you a choice of place: where the opposite party carries on business, or where the cause of action arose. For an online purchase delivered to your address, part of the cause of action generally arises where the goods were delivered, which is usually the district you live in. Do not assume it; check it against your invoice and the seller's stated address before drafting.

What to file with the complaint

  • The invoice and the order confirmation.
  • Proof of payment and the delivery record.
  • Photographs and video of the defect, with the serial number in frame.
  • The seller's and the brand's written refusals — email, chat or WhatsApp, printed with the date and number visible.
  • A two-page complaint setting out the purchase, the defect, the correspondence, and the relief you want: replacement or refund, plus compensation.
  • A short affidavit in support, and an index of the documents relied on.

Filing is now largely done through the e-Daakhil portal, which lets you file and track the case online. Filing fees are set by the rules according to the value of the claim and are nominal at the lower end, though you should confirm the current figure for your claim. If you have already run a complaint on the National Consumer Helpline, attach that trail as well — it shows you tried.

Notice to the opposite party is not a precondition for a consumer complaint. Sending one is still worth it: it is cheap, it sometimes produces the refund without a hearing, and if the other side stays silent, the notice becomes part of your record. Once the complaint is admitted, the District Commission can order a refund, a replacement, removal of the deficiency or compensation for loss — Section 39 lists the reliefs. The Commission can also refer the matter to mediation if both sides consent, which is often the fastest route to a refund in a case this small.

Frequently Asked Questions

I signed the open-box inspection slip. Does that end my claim?

No. You signed for what you could see. A signature confirming external condition is not a statement that the monitor actually works, and it is not a waiver of your right to functioning goods. Expect the other side to raise it, and expect the Commission to ask what a two-minute door inspection could reasonably have revealed about a panel defect.

Should I send a legal notice before filing?

It is not mandatory. A written demand email sent to both the seller and the manufacturer, giving them fifteen days and stating clearly what you want, does most of the same work. Keep a copy with the delivery or read receipt.

Do I complain against the seller, the brand, or the platform?

Usually all three, in the alternative. The seller sold you the goods, the manufacturer refused warranty, and the platform ran the return process. Naming all three means the Commission can decide who is liable instead of dismissing your complaint for naming the wrong party.

Can I claim compensation for the harassment and the time lost?

You can ask. The Commission has the power to award compensation, and repeated refusals, automated replies and being pushed between the seller and the brand are the kind of conduct that supports a modest award. Keep your expectation modest. The refund is the main relief; compensation is the tail.

Can I file a police complaint instead?

A warranty refusal is not cheating. Section 318 of the Bharatiya Nyaya Sanhita, 2023 requires a dishonest intention from the beginning, and a seller who delivered a sealed unit and then argued about a return has not necessarily crossed that line. The consumer forum is the correct route. A criminal complaint here usually wastes months and gets closed.

What if the defect is caused by the courier?

That argument is between the seller and the transporter. Your contract is with the seller, and the seller carries the risk of getting the goods to you intact. If the seller says the courier broke it, that is a reason for the seller to pursue the courier, not a reason to leave you with a dead monitor. Your remedy sits with the party you paid.

What if the seller has already closed the return and marked the case resolved?

A closed ticket is a status inside their system, not an order of any court. Nothing about it stops you from filing. If anything, the closure email is useful, because it shows the refusal was deliberate and not a mix-up.

If your damaged monitor return has been refused, do this next

Write the chronology before you write anything else. Delivery date, date and time of first power-on, the date each return was raised, the date each was closed, the date of every refusal, and the date of the National Consumer Helpline complaint if you made one. One page, in order. The entire dispute turns on whether the fault existed when the box was handed over, and a clean sequence of dates does more for that argument than any section you cite.

Then send one written demand, to the seller and the manufacturer together, stating the order number, the date of delivery, what you found on switch-on, what you have already tried, and what you want — refund or replacement, within fifteen days. Attach the photographs and the video. Send it to the support email on the invoice as well as the grievance officer the e-commerce platform is required to publish. Keep the sent copy.

Check the invoice for the actual name and address of the seller. It is often not the brand and not the platform. The party you paid is the party you name first, and if the name on the invoice does not match the name on the website, that mismatch is worth noting in your complaint.

Put the unit back in the carton and leave it there. Do not hand it to a courier unless a written instruction says so and you have photographed the packaging, the serial number and the fault before it leaves your hands. Once it is out of your possession, the only proof of the defect is whatever you captured first.

And be honest with yourself about the weak spots, because the other side will find them. If the photographs were taken three weeks after delivery, if the inspection slip records that you tested the unit and accepted it, or if there is a gap in the correspondence where you did nothing, the case gets harder. It does not become impossible. It does change what a lawyer will tell you in the first sitting, and on some sets of facts there may be nothing worth arguing, in which case the advice will be to stop rather than to file.

What to send the chamber

If you want this looked at, send three things and nothing more to start with:

  • The invoice and the order confirmation, as they are.
  • The date of delivery and the date of first power-on.
  • A two-line note on what happened after that, with the refusals attached if you have them in writing.

That is enough to tell you whether you have a complaint, which Commission has jurisdiction, and what the realistic outcome is. You can reach the chamber through the contact page or book a consultation. Bring the documents, not a summary of them. Email me@sudhirrao.com or call +91 97295 06771.
