Should I wait for Flipkart's backend team?

No. You've waited 2.5 months. That's more than reasonable. Waiting further will only delay your remedy and may push the matter beyond the limitation period for filing a consumer complaint.

Will a legal notice actually work?

Under the Consumer Protection Act, 2019, a complaint must be filed within two years from the date on which the cause of action arose. Can the Matter Be Settled Out of Court?

Yes, absolutely. Consumer disputes are amenable to settlement at any stage. Many e-commerce companies prefer to settle after receiving a legal notice rather than face a consumer forum order. Settlement options include:

  • Pre-litigation mediation: Through a consumer mediation cell
  • After filing: The forum can refer the matter to mediation under Section 79 of the Consumer Protection Act
  • Lok Adalat: If the matter is pending, it can be taken up in a Lok Adalat for a speedy compromise

Yes. COD does not affect your consumer rights. You paid for the product, and Flipkart delivered a defective product. You are entitled to a refund regardless of the payment method.
