One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.
Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.
TL;DR: Yes, this is a consumer court case, and a reasonably strong one. A seller who advertises 48-hour dispatch, sits on the order for weeks, refuses a written cancellation and then ships anyway is exposed on two separate grounds, deficiency in service and unfair trade practice. Accepting delivery under protest does not waive your refund claim. It usually strengthens it.
The email landed on 28 September. Two lines. The order could not be cancelled, and no refund would be issued. The reason given was that it was still being processed.
