One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.
Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.
TL;DR: A career consultancy refund claim is usually a consumer matter, not a criminal one. If you paid for a job-search service and got wrong or no service, you can send a legal notice demanding a refund and then file a complaint before the District Consumer Commission under the Consumer Protection Act, 2019. A police complaint only makes sense if you can show the firm intended to cheat you from day one.
Key Facts of the Case
- The client, based in Nagpur, engaged a job-search consultancy in March 2024 and paid ₹40,000 upfront.
- He had clearly specified he wanted roles in Hyderabad or remote positions. Nothing was put in writing as a guaranteed deliverable, only as a broad understanding over email.
- The consultancy applied on his behalf to companies he had not approved, including one where he had already been interviewed and rejected.
- It also applied to his own current employer, without his consent.
- Ten months passed with no interview arranged through the service and no meaningful correction despite repeated emails.
- He asked for a full refund and received no response.
- He held the complete email trail, payment proof and application records, which became the backbone of the notice and the subsequent complaint.
The Direct Legal Answer
Short answers first, procedure after. That is the order that helps.
Is this a deficiency in service?
On these facts, likely yes. A paid job-search service is a "service" under the Consumer Protection Act, 2019. If the provider fails to perform in the manner it represented, or performs in a way that falls short of the quality and nature of what was promised, that is a deficiency. Applying to companies the client never approved, and to his own employer, is the strongest part of the case. Silence and no interviews over ten months add to it.
Should I send a legal notice before approaching the Consumer Commission?
It is not a legal precondition for filing, but send it. A well-drafted notice that names each specific failure, rather than saying only "no interviews were arranged", gives the firm a chance to pay and gives you a dated record of refusal. Many service providers settle at this stage. If they ignore it, the notice becomes your first exhibit.
Can I file a police complaint instead?
Only if there is material showing dishonest intention from the very beginning. Poor service, delay or unmet expectations are not cheating. The criminal route is for cases where the firm never intended to deliver at all.
Advice in Such Cases
Consult with Lawyer: The very basic and important step to start is talk to Lawyer / advocate. You should not hesitate in paying his consultation fee i.e. might be in range of Rs. 10,000 to 50,000 depends case to case. He is helping you in this situation to come out. He is expert in the domain and can help you explain the procedure which you might have never explored. A good lawyer can get the issues resolved much faster than you think.
Before the consultation, print the email trail in date order and mark the three or four emails where you set out what you wanted. Those are the emails that decide the case.
Do not keep negotiating on the phone. Move the conversation to email, where the firm's replies become evidence rather than your recollection.
Matters like this turn on procedural and evidentiary detail, such as how the written version is framed and which emails are placed on record. Advocates who handle consumer matters regularly tend to get to the point faster than a general practice lawyer who meets the forum occasionally.
Applicable Sections of Law
Section 2(11) of the Consumer Protection Act, 2019 defines "deficiency" as any fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance required by law or undertaken under a contract. That is the heart of a career consultancy refund claim.
Section 2(42) defines "service", and paid career or job-search consultancy work falls inside it.
Section 35 read with Section 34 governs how and where a complaint is filed before the District Commission.
Section 39 sets out the reliefs the District Commission can grant, which include refund of the amount paid, compensation for loss and mental agony, and litigation costs.
On the contract side, Section 73 of the Indian Contract Act, 1872 allows compensation for loss caused by a breach.
Jurisdiction — Where to File a Career Consultancy Refund Case
The forum depends on the value of the service. For claims up to the currently notified limit of ₹50 lakh, the District Consumer Disputes Redressal Commission has jurisdiction under Section 34(1) of the Consumer Protection Act, 2019. A ₹40,000 claim sits comfortably there, and you do not need a high court for it.
Territorially, Section 34(2) lets you file where the opposite party actually or voluntarily resides or carries on business, or where the cause of action arose. Where the opposite party is a company, its registered office or branch office counts. If the consultancy operates online from another state, the place where you received the deficient service, or where you reside or work for gain, is usually the practical choice.
Getting jurisdiction wrong is the quickest way to lose six months on a technicality.
Limitation Period
Section 69 of the Consumer Protection Act, 2019 gives you two years from the date the cause of action arose. In this situation the clock generally starts when the deficiency became clear and, more practically, when the refund was refused or the firm went silent.
Two years sounds generous. It is not, once you account for the time spent following up. A complaint filed after the two-year mark can still be admitted under Section 69(2) if you show sufficient cause for the delay, but condonation is discretionary and you should never plan around it. File within time, and file early.
Interim Reliefs Available
The Consumer Commission can pass interim directions while the complaint is pending, for example directing the opposite party to deposit the disputed amount or to stop the deficient practice. For a ₹40,000 claim the practical interim relief is usually a direction to file a reply and appear, since the amount itself is modest.
Where the dispute is before a civil court, temporary injunction follows the principles in Order 39 of the Code of Civil Procedure, 1908, and Sections 36 to 38 of the Specific Relief Act, 1963. Attachment before judgment under Order 38 CPC is available where a defendant is about to dispose of property to defeat a decree. Interim relief matters most where the other side may simply disappear.
If You Are the Victim
- Stop all verbal communication. Put your demand in an email and keep a copy.
- Send a legal notice giving a clear deadline, usually fifteen days, and a specific amount.
- Keep the original payment receipt, bank or UPI statement, and every email thread with headers intact.
- Do not delete the consultancy's messages, even the frustrating ones. They are proof.
- File the consumer complaint within the two-year window rather than waiting for a refund that may never come.
Documents You Must Keep Ready
- Aadhaar and PAN card copies for the complaint and the affidavit.
- The signed engagement or service agreement, if there is one.
- Payment proof: bank statement, UPI record, card statement or receipt.
- The full email thread with the consultancy, printed in date order.
- Screenshots of job applications made on your behalf, and any rejection or interview records.
- Your written instruction about the kind of roles you wanted.
- Your refund request and the firm's response, or proof of no response.
- Any advertisement, brochure or WhatsApp message setting out what the firm promised.
What Evidence Is Required?
- The payment record, which is primary evidence of the transaction.
- Written communication showing what was agreed, in the form of emails or messages.
- The consultancy's own advertisement or promise, since that fixes the standard of service.
- Application records showing jobs you never authorised, and the ones sent to your current employer.
- Your refund demand and the reply, or the absence of one.
- A short affidavit from you setting out the sequence of events.
- Printouts of digital records, ideally with a certificate where electronic evidence is relied upon.
Where the email trail exists, you are relying on documents, not on memory. That is a much stronger position. Secondary evidence in the form of screenshots is accepted, but originals on your device or mail server are better.
How Courts Typically Approach Such Cases
Consumer Commissions look at three things: what was promised, what was paid, and what was actually delivered. The Commission is not interested in whether the job market was tough. It is interested in whether the firm did what it said it would do.
Courts are also wary of pure disappointment claims. If a firm genuinely applied to several relevant openings and no interview materialised, that may not be a deficiency, because no one guarantees an interview. What changes the picture is unauthorised applications, applications to the client's own employer, and a refusal to correct course after being told.
Expect the Commission to push for settlement at the first hearing. Take the offer seriously if it is close to the amount claimed.
Timeline of Legal Process
- Legal notice: drafting and dispatch takes about a week. The deadline given is usually fifteen days.
- Drafting and filing the complaint: one to two weeks, including the affidavit and the index of documents.
- Admission and notice to the opposite party: roughly one to two months from filing.
- Written version by the opposite party: usually thirty to forty-five days from service.
- Evidence and affidavits: six to twelve months, depending on the Commission's board.
- Final arguments and order: a further three to six months.
- Appeal to the State Commission under Section 41: must be filed within forty-five days of the order.
Realistically, a contested consumer complaint of this size runs eighteen months to three years. Uncontested ones often close far sooner, because the opposite party stops appearing.
Understanding the Costs
The total cost of a matter like this varies significantly from one case to the next — it depends on the complexity of the dispute, the forum involved, the number of hearings, and the specific facts of your situation. There is no single fixed figure that applies to everyone.
A professional advocate can give you an accurate estimate only after reviewing all your facts and documents in a consultation.
Can the Matter Be Settled Out of Court?
Yes, and for a claim of this size it is often the smartest route. Most such disputes end in a settlement because the amount at stake does not justify years of litigation for either side.
Consumer disputes can be referred to mediation, and Lok Adalats handle both pending and pre-litigation matters, where a settlement award is binding and no further appeal lies. Where a civil suit is pending, Section 89 of the Code of Civil Procedure, 1908 allows the court to refer the parties to arbitration, conciliation, judicial settlement or mediation.
Settlement is advisable when the offer is close to the principal amount and you want closure. It is not advisable when the firm admits nothing and offers a token amount. Record any Record any settlement in writing. A signed settlement agreement with the amount, the date of payment and the mode is the safest form. A WhatsApp message confirming the figures is better than nothing. Do not withdraw the complaint until the money is actually credited to your account, and if you are withdrawing it, file a memo before the Commission saying so and record that the settlement has been honoured. That is roughly how the client's matter stood when I last looked at it. Whether his eventual outcome was money back or a long wait is not something I am at liberty to describe, and reading any lesson into it would be unfair to him.
Can a career consultancy refund case be filed from another state?
Usually, yes. Section 34(2) of the Consumer Protection Act, 2019 allows the complaint where the opposite party resides or carries on business, or where the cause of action arose. Where the consultancy sits in another state but you paid from your account here, received its services here and were told here that nothing had been arranged, the cause of action has a real connection to your own place. Commissions have taken differing views on pure online transactions, so the safest filing is where you were when the deficient service was delivered.
File where you can appear without travelling. An adjournment because you could not reach the forum costs you a hearing date and, in a crowded board, several months.
Frequently Asked Questions
Do I really need a lawyer for a consumer complaint of ₹40,000?
No. You can file and argue the complaint yourself. Whether you should is a practical question about time and framing, not a legal requirement. The complaint, the affidavit and the index of documents have to be correct on the day of filing, and a defective complaint comes back for cure. Consult, decide, then file. There is nothing to gain by waiting on a consultation until the two-year mark is close.
What if the consultancy has shut down or stopped replying?
An unresponsive opposite party does not end your case. It often speeds it up, because the Commission can proceed ex parte after service. The difficulty is recovery, not the order. If the consultancy was a proprietorship or a partnership, the proprietor or partners can be made personally liable. Where it was a company, a breach of contract claim generally lies against the company and not against its directors personally, unless there is something more than a contractual default. Check the registration details before naming parties.
Can I go to the police for cheating?
The cheating provisions now sit in Section 318 of the Bharatiya Nyaya Sanhita, 2023, with the aggravated form involving dishonest inducement to deliver property in Section 318(4). What those sections require is a dishonest intention at the time of the transaction — a firm that took your money knowing it would never deliver. Service that was poor, delayed or indifferent is a civil wrong. It does not become a crime because you feel cheated. If your records show false claims about employers they had lined up, fake interview calls or an office that never existed, the criminal route becomes arguable, and it is worth getting that assessed before you file an FIR that will only be closed.
Can I claim compensation for mental agony and litigation expenses?
Yes. Section 39 of the Act allows the Commission to direct a refund, compensation for loss suffered, compensation for mental agony, and costs. Commissions are conservative on the quantum and usually scale it to the amount involved. Ask for it in the complaint with a figure; you will not be given what you never claimed.
What is the filing fee?
The fee is prescribed under the Consumer Protection (Consumer Disputes Redressal Commissions) Rules, 2020 and varies by the value of the claim. For a claim of this size it is small. Confirm the current schedule for the particular Commission before you draft the demand draft, because the fee goes on the index and the wrong instrument stalls admission.
Does it help if other people were also cheated by the same firm?
It can. Several complainants with the same pattern of unauthorised applications and ignored refund requests make it harder for the firm to call it one client's disappointment. Consumer law also permits a recognised consumer association to file on behalf of consumers. Do not coordinate informally and file identical complaints inconsistently; that is a hazard, not a strength.

What to Send Before the First Consultation
Bring the order of events on one page. Date you engaged the firm, amount paid, what you told them you wanted, what they actually did, the date you first asked for a refund, and whether any part of the money came back. Then attach the three documents that decide these matters: proof of payment, the written record of what was promised, and your refund request with the reply or the silence that followed.
If you never put your requirements in writing and the promise was only spoken over a call, say so upfront. It changes the strategy — the case then leans on the firm's own advertisement and on their conduct rather than on your instructions. On some facts there may be nothing worth arguing, and it is better to hear that in the first meeting than after a year of hearings.
