One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.
Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.
TL;DR: Yes, two people in a 498A and 307 IPC case can reconcile and live together again. Nothing in law stops them. But living together does not automatically end the criminal case. The cruelty charge can be compounded with the court's permission, while an attempt-to-murder charge cannot be compounded at all and generally has to be fought or quashed on its own merits.
The papers reached the Chamber of Advocate Sudhir Rao as a two-line question attached to a thick bundle. A couple in Pune. An FIR naming the husband and his relatives. Cruelty under the matrimonial cruelty provision, and alongside it, attempt to murder. The wife's family had lodged it. The husband's side denied everything outright.
Only one version was on record at that point. It stayed that way for a while. That's worth saying plainly, because a story this serious rarely arrives with both sides at once.
What the man wanted wasn't what most people in his position want. He didn't come asking for a divorce. He wanted to know whether he and his wife could still reconcile, and whether a criminal case of this kind made that impossible.
An earlier opinion had told him the marriage was over, and that once a criminal case starts there is nothing left to do but fight it. That advice wasn't wrong about the difficulty. It was incomplete. The attempt-to-murder charge cannot be compounded. The cruelty charge can, with the court's permission. Two facts, pulling in opposite directions, and any workable strategy has to hold both at once. Advocate Sudhir Rao and his office dealt with the arrest exposure first, and then built the reconciliation route on top of it. The client's position moved. Whether the marriage survives is not something a court decides.
Key Facts of the Case
- An FIR was registered against the husband and several of his relatives following a matrimonial dispute.
- The charges invoked cruelty by a husband or his relatives, and separately, attempt to murder.
- The couple had separated by the time the complaint was filed, and both families had given public versions of events that did not match.
- Only the complainant's version was before the investigating officer at the initial stage.
- The husband did not want a divorce. He wanted to know whether reconciliation and cohabitation were legally possible.
- He had earlier received general advice that a criminal case of this nature ends the marriage permanently.
- The two charges carry completely different compounding rules, which became the pivot of the strategy.
- The client approached the Chamber of Advocate Sudhir Rao after that earlier advice left him with no clear path.
