One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.
Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.
Mr.X approached me after purchasing a high-end electronic device worth approximately Rs. 1.7 lakhs from X.company. The device’s keyboard component failed within three months of purchase. Though X.company replaced the faulty component under warranty, the replacement part developed identical defects within two months. When Mr.X demanded a full refund citing repeated defects, X.company refused, invoking their 60-day refund policy and offering only another replacement. The company maintained that since the initial purchase was beyond 60 days, they were only obligated to provide repairs or replacements, not refunds. This left Mr.X frustrated with a defective product and mounting losses from work disruption. The case involved consumer protection laws and warranty obligations under Indian legislation.
Advice in Such Cases

He is expert in the domain and can help you explain the procedure which you might have never explored. A good lawyer can get the issues resolved much faster than you think.
Document all communications with the company including emails, warranty claims, and repair history. Preserve the defective product as evidence. File a consumer complaint within the limitation period. Gather purchase receipts, warranty cards, and technical reports showing repeated failures. Consider approaching consumer forums for expedited resolution.
Applicable Sections of Law
Under the Consumer Protection Act, 2019, consumers have rights against defective goods and deficient services. BNS Section 318 covers cheating and dishonestly inducing delivery of property. BNSS provisions govern evidence collection and complaint procedures. The Sale of Goods Act, 1930 provides remedies for breach of warranty conditions. Competition law may apply if the company has dominant market position. Consumer forums have jurisdiction under specific value thresholds for such disputes.
If You Are the Complainant
- File complaint with appropriate consumer forum based on purchase value
- Prepare chronological documentation of all defects and repair attempts
- Demand refund with interest and compensation for harassment
- Include claims for mental agony and litigation expenses
- Serve legal notice before filing formal complaint to create evidence trail
If You Are the Victim
- Immediately document the defect with photographs and technical reports
- Maintain all purchase receipts, warranty documents, and service records
- Send written complaints to company’s customer service with delivery confirmation
- Report the issue to consumer helplines and online consumer platforms
- Seek independent technical evaluation of the defective product from certified technicians
How the Police Behave in Such Cases
Police typically treat these as civil disputes rather than criminal matters unless fraud elements are clearly established. They may direct parties to consumer forums or civil courts. In cases involving cheating or criminal breach of trust, police may register FIR under relevant BNS sections. However, most consumer complaints are resolved through consumer protection mechanisms rather than criminal proceedings.
