After making the payment through online banking, he received the product within the promised delivery timeframe. However, upon opening the package, Mr.X discovered that the delivered item was completely different from what he had ordered – it was a different brand, different design, and inferior quality.

When Mr.X immediately contacted X.brand’s customer service to request a return and refund, they denied his request citing their return policy terms. The company claimed that since the product was delivered as per their system records, no return would be processed. Mr.X was left with an unwanted product and his money blocked. This situation led to a consumer dispute that required legal intervention to protect Mr.X’s rights and ensure proper compensation.

This case involves violations under the Bharatiya Nyaya Sanhita (BNS) Section 316 (Criminal breach of trust), Section 318 (Cheating), and Section 61 (Dishonestly inducing delivery of property). Under the Bharatiya Nagarik Suraksha Sanhita (BNSS), Section 173 provides procedures for filing complaints in such matters. The Consumer Protection Act, 2019 also applies, covering unfair trade practices, deficiency in service, and misleading advertisements.
