Mr. X visited a restaurant in City A during the last week of DD/MM/YYYY and attempted to pay his bill using his X Bank credit card. The POS machine displayed a transaction failure message, so he immediately paid the same amount using his Y Bank credit card. However, when Mr. X received his X Bank credit card statement in the following month, he discovered that the “failed” transaction had actually been processed and debited from his account. This resulted in him being charged twice for the same meal – once through the supposedly failed transaction and once through the successful payment. The restaurant had no record of receiving payment from X Bank, creating a complex dispute situation involving multiple parties.

Applicable Sections of Law

This type of dispute falls under several provisions of Indian law. Section 318 of BNS deals with cheating and dishonestly inducing delivery of property. Section 420 of BNS addresses cheating and dishonestly inducing delivery of property, which may apply if the merchant knowingly processed duplicate charges. The Bharatiya Nagarik Suraksha Sanhita (BNSS) Section 173 provides procedures for investigation of such complaints. Additionally, the Consumer Protection Act, 2019 and Reserve Bank of India guidelines on credit card disputes provide specific remedies for banking transaction disputes and unauthorized charges.

Investigation usually involves examining transaction logs, POS machine records, and merchant account statements. Police coordination with cyber crime cells may be required for technical analysis of payment gateway failures and duplicate processing issues.
