One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.
Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.
Mr. X ordered ice cream worth Rs. Y from X.delivery app in City A on DD/MM/YYYY. Upon delivery, he discovered the ice cream tub had a broken seal with visible signs that the product had been tampered with – significant quantity was missing and the seal was clearly compromised. This posed serious health risks as the product could have been contaminated. When Mr. X complained to X.delivery, they offered only Rs. Z as refund against the total order value of Rs. Y, essentially expecting him to consume the potentially contaminated product. The company’s response was inadequate considering the health hazard and clear violation of consumer rights regarding product quality and safety standards.
