Mr.X purchased diamond jewelry worth Rs. 41,683 from X.brand on DD/MM/YYYY with a promised delivery date of DD/MM/YYYY. The delivery was delayed by several days, and when finally delivered, the product had a carat discrepancy of 0.02. The company initially cited migration issues for the delay. Mr.X faced both service deficiency in timely delivery and product quality issues regarding the actual specifications not matching the purchased item. This dual problem of delayed delivery and product discrepancy created a strong case for consumer court action under consumer protection laws.

The primary remedy lies in consumer protection laws rather than criminal provisions, as this involves service deficiency and product quality issues rather than criminal intent.
If You Are the Complainant
- File complaint in District Consumer Forum for claims between Rs. 20 lakh to Rs. 1 crore
- Prepare comprehensive documentation including purchase receipt, delivery communications, and product evaluation
- Calculate exact damages including delay compensation and quality difference costs
- Include prayer for refund, replacement, or compensation along with litigation costs
- Submit complaint within two years from the cause of action
If You Are the Victim
- Immediately document the product discrepancy with photographs and measurements
- Request written explanation from the seller regarding delivery delays and quality issues
