BoAt Product Replacement Dispute - Consumer Rights Violation Case Analysis

My client, Rohit Sharma, a software engineer residing in Lajpat Nagar, Delhi, purchased premium wireless earbuds worth Rs. 8,500 from BoAt Electronics India Pvt Ltd through their official website on January 15th, 2024. The product, BoAt Airdopes Elite (Ocean Blue variant), was delivered the next day in excellent packaging condition. However, upon testing, Rohit discovered persistent static noise from the right earbud during audio playback. He immediately contacted customer service for replacement under warranty terms. The company’s customer service team initially acknowledged the defect and promised a replacement within 7-10 business days. However, after multiple follow-ups over three weeks, the replacement was denied citing “user mishandling” without proper investigation. The company refused to honor their warranty obligations despite clear manufacturing defects, forcing Rohit to seek legal remedies for consumer rights violation and unfair trade practices.

Advice in Such Cases

Consult with Lawyer: The very basic and important step to start is talk to Lawyer / advocate. You should not hesitate in paying his consultation fee i.e. might be in range of Rs. 10,000 to 50,000 depends case to case. He is helping you in this situation to come out. He is expert in the domain and can help you explain the procedure which you might have never explored. A good lawyer can get the issues resolved much faster than you think.

Document all communications with the company including emails, call recordings, and chat transcripts. Preserve the original packaging, bill, and warranty card as evidence. File a complaint with the Consumer Forum immediately as delays can weaken your case. Consider approaching the District Consumer Disputes Redressal Commission for claims up to Rs. 1 crore.

Applicable Sections of Law

Under the Bharatiya Nyaya Sanhita (BNS), Section 316 addresses cheating by dishonestly inducing delivery of property, applicable when companies deny legitimate warranty claims. Section 318 covers cheating and dishonestly inducing persons to deliver property. The Consumer Protection Act, 2019 provides comprehensive protection with Sections 2(7) defining defective goods and Section 2(47) covering unfair trade practices. The Bharatiya Nagarik Suraksha Sanhita (BNSS) Section 173 governs complaint procedures and Section 182 deals with cognizable offenses in commercial disputes involving consumer rights violations.

Relevant Legal Precedents

Various High Courts have established that manufacturers cannot arbitrarily deny warranty claims without proper investigation and evidence of consumer mishandling. The Supreme Court has consistently held that burden of proof lies with manufacturers to demonstrate that defects arose from consumer negligence rather than manufacturing faults. Courts have also ruled that unilateral warranty denial by companies constitutes unfair trade practice and entitles consumers to compensation including mental harassment damages.

If You Are the Victim

Immediately stop using the defective product to prevent further damage or safety risks. Send legal notice to the manufacturer demanding replacement or full refund with reasonable timeline for response. File complaint with Consumer Forum seeking appropriate relief including punitive damages for harassment and unfair denial of legitimate warranty claims. Consider approaching consumer helplines and online platforms for initial resolution before legal proceedings. Maintain detailed records of all expenses incurred due to product defects and company’s unresponsive behavior.

How the Police Behave in Such Cases

Police generally treat consumer disputes as civil matters unless fraud or criminal breach of trust elements are clearly established. They may refer complainants to Consumer Forums or suggest approaching commercial courts. In cases involving larger financial frauds or systematic consumer cheating, police may register FIR under relevant BNS sections. However, most product replacement disputes require consumer forum intervention rather than criminal proceedings for effective resolution.
