Mr.X had made a payment to clear his credit card dues with XYZ Bank. However, due to a banking error, the payment was mis-credited to a different credit card account. This left his original account showing as unpaid despite having made the full payment. For 864 days, Mr.X faced continuous harassment from the bank’s recovery agents, damaged credit score, and mental agony. He approached the RBI Ombudsman and won the case, with the bank being directed to correct the error and pay ₹20,000 as compensation. However, Mr.X felt this amount was inadequate considering the prolonged harassment and decided to approach the Consumer Court for higher compensation, seeking damages for mental harassment, credit score damage, and deficiency in banking services.

First approach the RBI Ombudsman as it’s free and faster. Document all communications with the bank including emails, letters, and call recordings. Applicable Sections of Law

Under BNS, Section 318 covers cheating and dishonestly inducing delivery of property, applicable when banks wrongfully collect money. BNSS Section 173 deals with investigation procedures. The Consumer Protection Act, 2019 provides remedies for deficiency in banking services. RBI guidelines mandate proper handling of customer grievances, and violation constitutes deficiency in service. Banking Ombudsman Scheme provides the first level of redressal, while Consumer Courts offer broader compensation powers including punitive damages.

If You Are the Complainant

File complaint with RBI Ombudsman within one year of bank’s final reply or within one year of incident if no reply received. Gather all documentary evidence including payment receipts, bank statements, and correspondence. Maintain detailed records of harassment incidents with dates and agent names. If RBI decision is unsatisfactory, approach Consumer Court within 30 days. Calculate actual damages including credit score repair costs, mental agony, and loss of business opportunities. How the Police Behave in Such Cases

They may register complaint under BNS sections if harassment becomes threatening or involves criminal intimidation. However, police often advise pursuing RBI Ombudsman route first. In cases involving recovery agent misconduct, police may take cognizance under relevant harassment sections. Documentation of threats or physical harassment strengthens police complaint viability.

Overall resolution through Consumer Court route generally completes within 12-24 months from initial complaint filing.
