Mr.X approached me when his account with X Bank was suddenly suspended without prior notice. Initially, he received no communication from the bank explaining the suspension. However, after the suspension, he started receiving frequent calls claiming to be from the bank. These calls made him suspicious as the timing seemed unusual – why would the bank call after suspending the account rather than before? The callers were asking for personal information and account details, which raised red flags about potential fraud attempts. Mr.X was concerned whether these were legitimate bank representatives or fraudsters trying to exploit his vulnerable situation. The account suspension had already caused him financial hardship as his salary account was blocked, and now these suspicious calls were adding to his anxiety about possible identity theft or further financial crimes being committed using his information.

For cyber fraud, Section 66D of Information Technology Act remains applicable alongside BNS provisions. Under Bharatiya Nagarik Suraksha Sanhita (BNSS), Section 173 allows filing complaints for such offenses. Banking Regulation Act 1949 governs wrongful account suspensions, while RBI guidelines mandate banks to provide proper notice before account suspension.
