Mr.X approached me when his account with X.Bank suddenly got frozen without any prior notice. He discovered this when his salary credit failed and ATM transactions were declined. Upon inquiry, the bank informed him that his account was frozen due to an NCRP (National Cyber Crime Reporting Portal) complaint and cyber alert from law enforcement agencies. Mr.X had no knowledge of any fraudulent activity and was shocked by this development. The bank’s customer service was unhelpful, continuously asking him to wait for further updates from investigating authorities. His monthly EMIs, utility bills, and family expenses were severely affected. After weeks of frustration with no resolution, he sought legal assistance to understand his rights and expedite the unfreezing process.

Applicable Sections of Law
Bank account freezing in cyber crime cases typically involves provisions under Bharatiya Nyaya Sanhita (BNS) Section 318 (cheating), Section 319 (cheating by personation), and Section 66 of Information Technology Act. Under Bharatiya Nagarik Suraksha Sanhita (BNSS), Section 105 allows attachment of property during investigation. Section 102 of BNSS governs seizure of property by police officers. Banking Regulation Act 1949 and RBI guidelines also apply regarding customer rights and bank obligations during such freezing orders.

- Approach NCRP portal online with complete details and upload all relevant documents
- Simultaneously file complaint at local cyber crime police station with physical copies
- Maintain detailed records of all communication with banks and authorities

How the Police Behave in Such Cases

Investigation process is usually slow, and police may not actively pursue unfreezing unless specifically requested. Account holders are expected to prove their innocence rather than police proving guilt, creating practical difficulties for genuine customers.
