Mr.X approached me when his bank account was suddenly frozen by authorities. He discovered that Mr.Y, an acquaintance, had been running a cybercrime scam and had instructed multiple victims to transfer money to Mr.X’s account. The victims, realizing they were scammed through blackmail tactics, filed complaints with the police after approximately one month. Mr.X was completely unaware of Mr.Y’s illegal activities and had simply allowed his account to be used, thinking it was for legitimate business purposes. The police froze his account as part of their investigation, leaving Mr.X unable to access his funds and facing potential criminal charges for his unwitting involvement in the scam.

Consult with Lawyer: The very basic and important step to start is talk to Lawyer / advocate. You should not hesitate in paying his consultation fee i.e. might be in range of Rs. 10,000 to 50,000 depends case to case. He is helping you in this situation to come out. Immediately gather all communication records with the person who used your account. Document your legitimate banking history and transactions. File a complaint against the actual scammer to establish your victimization. Cooperate fully with investigating authorities while protecting your rights through legal representation.
Applicable Sections of Law
Under Bharatiya Nyaya Sanhita (BNS), Section 318 deals with cheating and dishonestly inducing delivery of property. Section 319 covers cheating by personation. Section 66 of BNS addresses computer-related offenses. Under Bharatiya Nagarik Suraksha Sanhita (BNSS), Section 102 governs attachment and forfeiture of property during investigation. These provisions collectively address cybercrime, account misuse, and the procedural aspects of freezing accounts in criminal investigations.
If You Are the Complainant
File a detailed complaint with cybercrime cell providing complete transaction details and evidence of the scam. Submit all communication records with the scammer including messages, calls, and emails. Provide bank statements showing unauthorized transactions and financial losses. Cooperate with investigating officers and provide additional information when requested. Maintain copies of all documents submitted and follow up regularly on investigation progress.
If You Are the Victim
Immediately engage a criminal lawyer to represent your interests and protect you from wrongful prosecution. Gather all evidence proving your innocence and lack of knowledge about the scam. File a counter-complaint against the actual perpetrator who misused your account. Apply for unfreezing of your account through proper legal channels with court intervention if necessary. Maintain detailed records of all your legitimate transactions and banking activities to demonstrate your innocence.
How the Police Behave in Such Cases
Police typically freeze accounts immediately upon receiving cybercrime complaints to prevent further money laundering. They conduct thorough investigation of all linked accounts and transactions. Account holders are often treated as suspects initially until their innocence is established. Cooperation with investigation is expected, and non-cooperation may lead to arrest. Police may seize devices and documents for forensic examination during the investigation process.
