One of my clients recently had a case which I am explaining below and if you are stuck in such similar situation, here is what to do.
Note: Due to attorney-client privilege, I cannot disclose complete case details or identify the actual parties involved. However, I am sharing the essential facts and legal approach so that if you find yourself in a similar situation, you can understand the available solutions and legal remedies.
Mr.X approached me with a complex situation involving his family’s Aadhaar documentation. All family members – Mr.X, his mother Mr.Y, and father Mr.Z – had Aadhaar cards showing an address of a rental flat in City A from 15 years ago. The family had long since moved out, with members now residing in different cities. Mr.X faced legal complications when applying for a bank loan, as verification agencies discovered the address mismatch. The bank flagged potential identity fraud concerns. Government service applications were rejected due to address inconsistencies. Additionally, Mr.X received a legal notice regarding unpaid dues at the old address, even though he hadn’t lived there for years. The outdated documentation created multiple legal vulnerabilities and administrative hurdles for the entire family.

The Bharatiya Nyaya Sanhita (BNS) contains several relevant provisions. Section 318 addresses cheating by personation, which could be invoked if incorrect address information is used fraudulently. Section 336 covers forgery of documents, applicable if false address proofs are submitted. Under BNSS Section 35, police can investigate discrepancies in identity documents. Section 174 of BNS deals with false information to public servants, relevant when submitting incorrect address details to government agencies. These provisions ensure that maintaining accurate personal documentation is not just administrative requirement but legal obligation with potential consequences for non-compliance.

How the Police Behave in Such Cases
Police typically treat address discrepancy cases seriously when fraud is suspected. They may conduct verification visits to both old and current addresses. Officers often require extensive documentation proving legitimate residence changes. Investigation involves checking with landlords, neighbors, and utility providers. Police cooperation varies – some are understanding of genuine administrative delays, while others may be suspicious of intentional document falsification.
